Not w ithstanding an y other provision of law, funds made available in this title are in addition to amounts appropriated or otherwise made available for the Department of Defense for fiscal year 2009. (INCLUDING TRANSFER OF FUNDS) SEC. 302. U pon the determination of the Secretary of Defense that such action is necessary in the national interest, the Secretary may transfer between appropriations up to $2,500,000,000 of the funds made available to the Department of Defense in this title

d, That the Secretary shall notify the Congress promptly of each transfer made pursuant to the authority in this section: Provided fu r th er, That the authority provided in this section is in addition to any other transfer authority available to the Depart- ment of Defense and is sub j ect to the same terms and conditions as the authority provided in section 8005 of the Department of Defense Appropriations Act, 2009 ( division C of Public Law 110 – 329 ) except for the fourth proviso. SEC. 303. Funds appropriated by this Act, or made available by the transfer of funds in this Act, for intelligence activities are deemed to be specifically authori z ed by the Congress for purposes of section 504(a)(1) of the National Security Act of 1947 (50 U.S.C. 414(a)(1)). (INCLUDING TRANSFER OF FUNDS) SEC. 304. During fiscal year 2009 and from funds in the ‘‘Defense Cooperation Account’’, as established by 10 U.S.C. 2608, the Secretary of Defense may transfer not to exceed $6,500,000 to such appropriations or funds of the Department of Defense as the Secretary shall determine for use consistent with the purposes for which such funds were contributed and accepted: Provided , That such amounts shall be available for the same time period as the appropriation to which transferred: Provided further, That the Secretary shall report to the Congress all transfers made pursu- ant to this authority.
