123STA T . 1 8 8 5PUBLIC LA W 111 – 32 —J U NE 2 4, 2 0 0 9loca lca p ac ity:Provide d fu r th er ,Th at n ol es s than $20 0,000,000 shall b et r ans f erre d to the C enters for D isease Control and P re v en - tion to carry o u t g lobal and do m estic disease surveillance, laboratory capacity and research, laboratory diagnostics, ris k communication, rapid response, and q uarantine: Provided further, That products purchased w ith these funds may, at the discretion of the S ecretary of H ealth and Human Services (‘ ‘Secretary ’ ’ ) , be deposited in the Strategic N ational Stockpile under section 319F– 2 of the Public Health Service A ct: Provided further, That notwithstanding section 4 9 6 (b) of the Public Health Service Act, funds may be used for the construction or renovation of privately owned facilities for the production of pandemic influen z a vaccine and other biologics, where the Secretary finds such a contract necessary to secure sufficient supplies of such vaccines or biologics: Provided further, That funds appropriated in this paragraph and not specifically designated in this paragraph may be transferred to, and merged with, other appropriation accounts of the Department of Health and Human Services and other Federal agencies, as determined by the Secretary to be appropriate, to be used for the purposes specified in this paragraph and to the fund authorized by section 319F–4 of the Public Health Service Act: Provided further , That transfers to other Federal agencies shall be made in consultation with the Director of the O ffice of M anagement and B udget: Provided further, That 1 5 days prior to transferring any funds in this paragraph, the Secretary shall notify the Committees on Appropriations of the House of R epresentatives and the Senate of any such transfer and the planned uses of the funds: Provided further, That the transfer authority provided in this paragraph is in addition to any other transfer authority available in this or any other Act . For an additional amount for ‘‘Public Health and Social Services E mergency Fund’’ to prepare for and respond to an influenza pan- demic, including the development and purchase of vaccine, antivirals, necessary medical supplies, diagnostics, and other surveillance tools and to assist international efforts and respond to international needs, $5, 8 00,000,000, to remain available until e x pended: Provided, That products purchased with these funds may, at the discretion of the Secretary of Health and Human Services, be deposited in the Strategic National Stockpile under section 319F–2 of the Public Health Service Act: Provided further, That funds provided in this paragraph shall be available for obliga- tion only in the amounts designated by the President in one or more written notices to the Congress as emergency funds required to address critical needs related to emerging influenza viruses: Provided further, That funds appropriated in this paragraph may be transferred to, and merged with, other appropriation accounts of the Department of Health and Human Services and other Federal agencies to be used for the purposes specified in this paragraph and to the fund authorized by section 319F–4 of the Public Health Service Act: Provided further, That transfers to other Federal agen- cies shall be made in consultation with the Director of the Office of Management and Budget: Provided further, That none of the funds provided in this paragraph shall be made available for obliga- tion until 15 days following the submittal of a detailed obligation plan to the Committees on Appropriations of the House of Rep- resentatives and the Senate by the Department of Health and Deadlin e .Ob li g a t i o n p lan.
