ADOPTION OF INITIA L SET OF STANDARDS , IMPLEMENTATION SPECIFICATIONS, AND CERTIFI- CATION CRITERIA. ‘ ‘ (a)PROCES S F OR AD O PTI O N OF E NDORSED R ECO M MEND A- TIONS .— ‘‘( 1 )RE V IE W OF ENDORSED STANDARDS , IMP L EMENTATION SPECIFICATIONS, AND CERTIFICATION CRITERIA.— Notl at er t h a n90d a ys a f ter the date of re c e ip t of standards, i m plementation specifications, or certification criteria endorsed u nder section 3 001(c), the S ecretary, in consultation w ith representati v es of other relevant F ederal a g encies, shall j ointly review such stand- ards, implementation specifications, or certification criteria and shall determine whether or not to propose adoption of such standards, implementation specifications, or certification cri- teria. ‘‘( 2 ) D ETERMINATION TO ADOPT STANDARDS, IMPLEMENTA- TION SPECIFICATIONS, AND CERTIFICATION CRITERIA.— I f the Sec- retary determines— ‘‘(A) to propose adoption of any grouping of such stand- ards, implementation specifications, or certification criteria, the Secretary shall, b y regulation under section 5 53 of title 5, U nited States C ode, determine whether or not to adopt such grouping of standards, implementation speci- fications, or certification criteria
or ‘‘( B ) not to propose adoption of any grouping of stand- ards, implementation specifications, or certification criteria, the Secretary shall notify the National Coordinator and the H I T Standards Committee in writing of such deter- mination and the reasons for not proposing the adoption of such recommendation. ‘‘(3) P UB LICATION.—The Secretary shall provide for publica- tion in the Federal Register of all determinations made by the Secretary under paragraph (1). ‘‘(b) ADOPTION OF STANDARDS, IMPLEMENTATION SPECIFICA- TIONS, AND CERTIFICATION CRITERIA.— ‘‘(1) IN G ENERAL.—Not later than December 31, 2009, the Secretary shall, through the rulema k ing process consistent with subsection (a)(2)(A), adopt an initial set of standards, implementation specifications, and certification criteria for the areas re q uired for consideration under section 3002(b)(2)(B). The rulemaking for the initial set of standards, implementation specifications, and certification criteria may be issued on an interim, final basis. ‘‘(2) APPLICATION OF CURRENT STANDARDS, IMPLEMENTATION SPECIFICATIONS, AND CERTIFICATION CRITERIA.—The standards, implementation specifications, and certification criteria adopted before the date of the enactment of this title through the process e x isting through the O ffice of the National Coordinator for Health Information Technology may be applied towards meeting the requirement of paragraph (1). ‘‘(3) SUBSE Q UENT STANDARDS ACTIVIT Y .—The Secretary shall adopt additional standards, implementation specifications, and certification criteria as necessary and consistent with the schedule published under section 3003(b)(2).
