( a )FUND IN G . —O f the funds appropriated in titles I IIandI V of this Act, not m ore than $5 45,050,000 shall be a v ailable for assistance for C olombia. Funds appropriated by this Act and made available to the D epartment of State for assistance to the G overnment of Colombia may be used to support a unified campaign against narcotics traf - fic k ing and organi z ations designated as Foreign T errorist Organiza- tions and successor organizations, and to take actions to protect human health and w elfare in emergency circumstances, including undertaking rescue operations

d , That assistance made available in prior Acts for the Government of Colombia to protect the Cano- L imon pipeline may also be used for purposes for which funds are made available under the heading ‘ ‘Andean Counterdrug P rograms ’ ’: Provided fu r th er, That no U nited States Armed Forces personnel or United States civilian contractor employed by the United States will participate in any combat operation in connection with assistance made available by this Act for Colombia: Provided further, That rotary and fi x ed wing aircraft supported with funds appropriated under the heading ‘‘Andean Counterdrug Programs’’ for assistance for Colombia may be used for aerial or manual drug eradication and interdiction including to transport personnel and supplies and to provide security for such operations, and to provide transport in support of alternative development programs and investigations of cases under the j urisdiction of the Attorney General, the Procuraduria General de la N acion, and the Defensoria del Pueblo: Provided further, That the President shall ensure that if any helicopter procured with funds in this Act or prior Acts making appropriations for the Department of State, foreign oper- ations, and related programs, is used to aid or abet the operations of any illegal self-defense group, paramilitary organization, illegal security cooperative or successor organizations in Colombia, such helicopter shall be immediately returned to the United States. Of the funds available under the heading ‘‘Andean Counterdrug Programs’’ in this Act for the Colombian national police for the procurement of chemicals for aerial coca and poppy eradication programs, not more than 2 0 percent of such funds may be made available for such eradication programs unless the Secretary of State certifies to the Committees on Appropriations that: ( 1 ) the herbicide is being used in accordance with E PA label re q uirements for comparable use in the United States and with Colombian laws

and (2) the herbicide, in the manner it is being used, does not pose unreasonable risks or adverse effects to humans or the environ- ment, including endemic species: Provided, That such funds may not be made available unless the Secretary of State certifies to the Committees on Appropriations that complaints of harm to health or licit crops caused by such aerial eradication are thoroughly evaluated and fair compensation is being paid in a timely manner for meritorious claims: Provided further, That such funds may not be made available for such purposes unless programs are being implemented by the United States Agency for International Development, the Government of Colombia, or other organizations, in consultation and coordination with local communities, to provide Certif i ca ti on.
