A Legacy for Users (119 Stat. 1256) is amended by striking the project description for item number 189 and inserting the following: ‘ ‘Plan - ning, design, engineering, environmental analysis, acquisition of rights-of-way, and construction for the Long V alley B ypass ’ ’. (b) The table contained in section 1702 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (119 Stat. 1256) is amended by striking the project description for item number 3546 and inserting the following: ‘‘Port of Coos Bay to acquire and repair the Coos Bay Line’’. FE D E RALMOT OR CARR I ER SA F ET Y AD M I N I S TRATION MOTOR CARRIER SAFETY O P ERATIONS AND PRO G RAMS ( LI QU IDATION OF CONTRACT AUT H ORI Z ATION ) (LIMITATION ON O B LIGATIONS) (HIGH W AY TRUST FUND) (INCLUDING RESCISSION) For payment of obligations incurred for administration of motor carrier safety operations and programs pursuant to section 31104(i) of title 49, United States Code, and sections 4127 and 4134 of Public Law 109–59, $ 234,000,000, to be derived from the H ighway Trust Fund (other than the Mass Transit Account), together with advances and reimbursements received by the Federal Motor Car- rier Safety Administration, the sum of which shall remain available until expended: Provide d , That none of the funds derived from the Highway Trust Fund in this Act shall be available for the implementation, execution or administration of programs, the obligations for which are in excess of $234,000,000, for ‘‘Motor Carrier Safety O perations and Programs’’, of which $8,500,000, to remain available for obligation until September 30, 2011, is for the research and technology program and $1,000,000 shall be available for commercial motor vehicle operator’s grants to carry out section 4134 of Public Law 109–59: Provided fu r th er, That notwithstanding any other provision of law, none of the funds under this heading for outreach and education shall be available for transfer: Provided further, That the Federal Motor Carrier Safety Administration shall transmit to Congress a report on March 30, 2009 and September 30, 2009 on the agency’s ability to meet its requirement to conduct compliance reviews on high-risk carriers: Provided further, That $4,839,259 in unobligated balances are permanently rescinded.
