L Ons. 70, 71. 1886. 17 CHAP. 70. —An act authorizing the partition of certain land in Louisville, Ken- May 1, 1886. tucky, belonging jointly to John Echols and the Government of the United States. ———-—— Whereas a tract of ground situated in Louisville, Kentucky, adjoin- P.,.,,,,,,", of ing the Louisville and Portland Canal, and known as “Rowan’s Basin," lnnd owned by is owned by the United States of America and by John Echols in the John Echols and following proportion and under the following conveyances, to wit: The Fb° U“}*°Sl 8**** United States, as the proprietor of the Louisville and Portland Canal mI{’,.:::QH°* KY' and the owner of all the stock of the Louisville and Portland Canal ` Company, owns an undivided three-eighths of said real estate, by virtue of the ibllowing deeds: Une from lt. H. Campbell and others to the Louisville and Portland Canal Company, recorded in deed-book numbered one hundred and thirty-ive, page four hundred and twenty- three, and one from George H. Douglas to said canal company, recorded in deed-book numbered one hundred and thirty-seven, page four hundred and two, both in the J eifcrson County, Kentucky, clerk’s office; and said John Echols owns an undivided five-eighths of said real estate, under and by virtue of the tbllowing deeds to him, to wit: One from Eliza H. Boone and others, recorded in deed-hook numbered two hundred and fifty-tive, page one hundred and thirtyfour; one from Rebecca B. Rowan, trustee, and others, recorded in deedbook numbered two hundred and fifty-tour, page three hundred and eighty-two; one from Rowan Buchanan and others, recorded in deedbook numbered two hundred and fifty-four, page three hundred and sixty two; and one from Samuel J. Broadwell and others, recorded in deed—book numbered two hundred and fifty-four, page six hundred and two, all in the Jelferson County, Kentucky, clerk’s office; and it is to the interest of both parties that partition shall be made of said real estate: Therefore, - Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War of Secrets;-y of the United States is hereby authorized and empowered to agree with WM W ¤ST°¤ with said Echols, his heirs or his assigns, upon such partition of said real Eg:°l“““ '° l"‘m’ estate as may seem to the Secretary of War to be just and proper, and ' may, in the name of and on behalf of the United States of America, make, execute, and deliver to said Echols, his heirs or his assigns, and receive from him or them, such deed of conveyance as may eifectuatc the partition herein provided for. Sec. 2. That this act shall take en'ect from its passage. Approved, May 1, 1886. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Schuylkill River East Right or ws? Side Railroad Company is hereby authorized to construct its railroad ga¤l{?d *°ES°{*g51; across the grounds of the United States forming a part of the grounds Rm,,;:fk,,'Q; my of the naval asylum and of the arsenal at Philadelphia, in the State of um, ,,m¤.i).¤d Pennsylvania; and for that purpose said company is hereby granted a naval asylum width of sixty feet across said grounds for its right of way through the ¢:?¤”i}¤» "*“'*‘°l· grounds aforesaid: Provided, That the location of said road through P M_ said grounds shall be approved by the Secretary of War and the Secre- Lcumn to bg tary of the Navy; and the damages for the use and occupation of the spp:-oved by Socright of way herein granted shall be fixed by a board of two Army §32?°m:€,3V*' officers appointed by the Secretary of War and one officer of the Navy mug W' appointed by the Secretary of the Navy and the payment of said damages so iixed shall be a condition precedent to the exercise of the rights by this act granted: And provided further, That in the construction of Bulkhead. said road through said grounds the said company shall be required to construct thereon a bulkhead upon the bulkhead line on the Schuylkill River, as tlxed by the portwardeus of the city of Philadelphia.
