CHAP. 742.-An act authorizing the erection of a bridge across the Missouri River """""’_ at Ponca, Nebraska. Be it enacted by the Senate and House oz; Representatives of the N¤b¤:¤¤¤ ¤¤<1¤¤1¤> United States of America in Congress assemb d, That is shall be law- Y,’{,yB”Q¤ ful for the Nebraska and Dakota Bridge Company, a corporation gi';' *° 0**5*- organized under the laws of Nebraska, or its successors or assigns, to 6 r' construct, under and subject to the conditions and limitations hereinafter provided, a bridge across the Missouri River at or near Ponca City, Nebraska, and lay on or over said bridge railway tracks for the more perfect connection of any and all railways that now are or which may hereafter be constructed to the Missouri River at or near Ponca Cit . or to the river on the epposite of the same near Ponca City, and ,,*,Y,*g,_,,‘T“"·'“‘°°·°‘°·* build, erect, and lay on an over said bridge ways for wagons and vehicles of all kinds, and for the transit of animals, and to keep up and maintain and o erate said bridge for the purposes aforesaid; an that when said bridlge is constructed all trains o all railroads terminating at said river and on the o posite side thereof, at or near Ponca City, Nebraska, shall be allowed to cross said bridge for reasonable compensation to be made to the owners of the same under the conditions and limitations hereinafter named. ’f°“¤~ The owners of said bridge may also charge and receive reasonable compensation or tolls for the transit over said bridge of all wagons, Prvvw carriages, vehicles, animals and foot-passengers: Promkied, That the Rezulsticna Secretary of War, may at any time prescribe such rules, re ulations and rates of toll for transit and transportation over said bridge as may be deemed proper and reasonable. SPM- Sec. 2, That any bridge built under the provisions of this act, shall be built as a high bridge, with unbroken and continuous s ans, all spans over the water-way to have a clear channel-way of not lbss than t ree hundred feet and a clear head·room of not less than fifty feet above high—water mark, and the piers of said bridge shall be parallel with the current of the river and the bridge itself at right angles 1*¤~*¤¤- thereto; Provided, That the person or persons or corporation build- Channel- ing said bridge, maygsubject to the approval of the Secretary of Wai-, enter upon the ban of said river eit er above or below the point of location of said bridge and confine the flow of the water to a permanent channel, and to do whatever may be necessary to accom lish said objects, but shall not impede or obstruct the navigation ofp said river, and shall be liable in damages for all injuries to private property; and all plans for such work or erections u n the banks of the river shall first be submitted to the Secretary otpo War for his a proval. That no bridge shall be erected or maintained) under the authority of this act which shall at any time obstruct the free naviaemm war to gation of said river; and no bridge shal be commenced or built under ‘*'*"""" °‘°· this act until the location thereof and the plans and specifications for its construction shall have been submitted to and a proved by the Secretary of War; and any change in the plan of such construction, or any a teration in the bridge after its construction, shall be subject to the like approval. C¤¤¤S¢¤- And whenever said bridge shall, in the oppinion of the Secretary _ of War, substantially obstruct the free navigation of said river, he ‘ is hereby authorized to cause such change or alteration of said bridge to be made as will eifectually obviate such obstruction, or its entire nemo val; and all such alterations shall be made and such obstructions
