Whenever any such dam or dams, canals, reservoirs and €tg’i““*°*P°* °°¤*’°*» auxiliary steam works, pole lines and conduits are to be constructed ` within the limits of any incorporated city or town in the Indian Territory, the municipal authorities of such city or town shall have the power to regulate the manner of construction therein, and nothing erein contained shall be-so construed as to deny the right of municipal taxation in such cities and towns: Provided, That all rights granted comm, of ereunder shall be sub`ect to the control of the future Territory or guinea ngms. That in addition to the powers now conferred by law, all g,.¥,,'{,,'{;i°,:,{’d'§li:,{,‘lf, municipalities in the Indian Territory having a population of over two P°"°*'¤· thousand to be determined by the last census taken under any provision of law or ordinance of the council of such municipality, are hereby authorized and empowered to order improvements of the streets or m¥e*gtg’g%°m°¤° °* alle s or such parts thereof as may beincluded in an ordinance or order ’ ` of the common council with the consent of a majority of the property owners whose property as herein provided is liable to assessment therefor for the proposed improvement; and said council is empowered and authorized to make assessments and levy taxes with the consent of a majority of the property owners whose property is assessed, for the purpose of grading, aving, macadamizing, curbing, or guttering streets and alleys, or building sidewalks upon and along any street, roadway or alley within the limits of such municipality, and the cost of such grading, paving, macadarnizing, curbing, gutteringor sidewalk constructed, or other improvements under authority of this section, shall be soassessedizgainst the abutting property as to resgaire each parcel of land to bear e cost of such grading, paving, mac amizing, curbing, guttering or sidewalk, as far as it abuts thereon. and in the case of streets or alleys to the center thereof; and the cost of street intersections or crossings may be borne by the city or apportioned to the quarter blocks abutting thereon upon the same basis. The SP°°**‘¤·*°¤°m°¤¤· s ecial assessments rovided for by this section and the amount to be charged against each lot or parcel of land shall be fixed by the city council or under its authority and shall become a lien on such abuttin property, which may be enforced as other taxes are enforced umler the laws in force in the Indian Territory. The total amount Hmmumcharged against any tract or parcel of land shall not exceed twenty per centum of its assessed value, and there shall not be reqpired to be paid thereon exceeding one per centum per annum on the assessed value and interest at six per centum on the deferred payments. For the purpose of paying for such improvements the city council cjigjwgf Emp °’ of such munici lity is hereby authorized to issue improvement script l or certificates gi- the amount due for such improvements, said script or certificates to be payable in annual installments and to bear interest from date at the rate of six per centum p-`erannum, but no improvement script shall be issued or so d for less t an its par value. All of said municipalities are hereby authorized to pass all ordinances necessary to carry into effect the above provisions and for the purpose of doing so may divide such municipality into improvement districts.
