[H‘ R' 26181] [Public, No. 424..] Be it enacted by the Senate and House of Represmtati·ves of the United — States of America in Ormgreaa assembled, That the Metropolitan Park §',}{}{;§ Ifxgbmd Commission, or any town or city, or any other public body authorized agimss between cmby the State of Massachusetts, all or any of them, be, and they hereby ir.? "G B°°t°“‘ are, authorized to construct, at ang time hereafter, drawless bridges ,_ across the Charles River in the tate of Massachusetts connecting River Street in Cambridge and Cambridge Street in the Brighton district, so called, of Boston, and at any other points upon said river, at, near, or above said Cambridge and River Streets: Provided, That said §;‘{§·]§gw_ bridges shall be at least twelve feet above the ordinary level of the ’ water in the basin over the main ship channel, and the piers and other obstructions to the flow of the river shall be constructed in such form C0 and in such places as the Secretary of War shall approve: Provided Owngswéiatiiiviurliig further-, That before the construction of said bridges or any of them P'°P°"Y· is begnm the State of Massachusetts shall by legislative enactment provide for adequate compensation for the owner, owners, lessee or essees of property abutting on said river above any of the isaid bridges, for damages if any caused to said property or leasehold interests therein by reason of interference with the access by water to said property, due to the construction of bridges without draws: Provided “,fS ‘° M further, That said legislative enactment shall provide for the appointment of three commissioners to hear the parties in interest an assess the damages to said proferty; their decision as to the amount of damages and chuestions o fact. to be final; said commissioners to be appointed by the Supreme Judicial Court of Massachusetts.
