DEFINI TIONS . -I n this Act, unless the context or sub- D e f i n i t i o n s t ject matter otherwise requires- " (a) `National Guard' or `National Guard of the several States, "National Guard . " Te rritorie s, and t he Distr ict of C olumbia' means t hat port ion of t he Organized Militia of the several States, Territories, and the District of Columbia, active and inactive, federally recognized as provided in this Act and organized, armed, and equipped in whole or in part at Federal expense and officered and trained under paragraph 16, section 8, article I of the Constitution . " (b) `Nat iona l Gu ard of the United St ates ' me ans a re serv e "Nati onal Gua rd of component of the Army of the United States composed of those the united states ." federally recognized units and organizations and persons duly ap- pointed and commissioned in the active and inactive National Guard of the several States, Territories, and the District of Columbia, who have taken and subscribed to the oath of office prescribed in section 73 of this Act, and who have been duly appointed by the President in the National Guard of the United States, as provided in this Act, and of those officers and warrant officers appointed as prescribed in sections 75 and 111 of this Act, and of those persons duly enlisted in Post, pp. 158, 160. the National Guard of the United States and of the several States, Territories, and the District of Columbia who have taken and sub . scri bed to the oath of enl istm ent pre scri bed in sec tion 70 of this Act . SEC . 10 . That section 72 of said Act be, and the same is hereby, a Vol, d 41, p. 78 1, amended by striking out the sa me and inserting the following in lieu thereof "SEC. 72 . An en listed m an disch arged fr om servi ce in th e Nation al Discharges ; and the National Guard of the United States shall receive a discharg e in wri ting in such for m and wi th such c lassific ation as is Draft feature elimi . or shall be prescribed for the Regular Army, and in time of peace nated . discharges may be given prior to the expiration of terms of enlist- ment under such regulations as the Secretary of War may prescribe ." SEC . 11 . That section 73 of said Act be, and the same is hereby, Vol.39, p.201. ame nd ed by striking out the sa me and inserting the following in lieu thereof " SEC. 73. OATHS OF NATIONAL GUARD OFFICERS-APPOINTMENT IN Oath of officers . THE NATIONAL GUARD OF THE UNITED STATEs .-Commissioned officers and warrant officers of the National Guard of the several States, Territories, and the District of Columbia and in the National Guard of the United States shall take and subscribe to the following oath of offi ce " I, , do solemnly swear that I w ill support and defend the Constitution of the United States and the constitution of the State of against all enemies, foreign and domestic ; that I will bear true faith and allegiance to the same ; that I will obey the orders of the President of the United States and of the Governor of the State of ; th at I make this obligation freely, without any mental reservation or purpose of evasion, and that I will well and faithfully discharge the duties of the office of in the National Guard of the United States and of the State of upon which Iam about to enter, so help meGod.
