AN ACT To provide that individuals enlisted into the Armed Forces of the United States shall take an oath to support and defend the Constitution of the United States.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,, That section 501 of title 10, United States Code, is amended as follows:
- §501. Enlistment oath: who may administer
"Each person enlisting in an armed force shall take the following oath: " 'I, , do solemnly swear (or aifirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same^ and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.' This oath or affirmation may be taken before any commissioned officer of any armed force." SEC. 2. Section 304 of title 32, United States Code, is amended to read as follows: "§ 304. Enlistment oath "Each person enlisting in the National Guard shall sign an enlistment contract and subscribe to the following oath: " ' I do hereby acknowledge to have voluntarily enlisted this day of_ , 19--, in the National Guard of the State of for a period of year(s) under the conditions prescribed by law, unless sooner discharged by proper authority. " 'I, , do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and of the State of against all enemies, foreign and domestic; that I will bear true faith and allegiance to them; and that I will obey the orders of the President of the United States and the Governor of and the orders of the officers appointed over me, according to law and regulations. So help me God.' This oath may be taken before any officer of the National Guard of the State or territory, or of Puerto Kico, the Canal Zone, or the District of Columbia, as the case may be, or before any other person authorized by the law of the jurisdiction concerned to administer oaths of enlistment in the National Guard." SEC. 3. This Act does not affect any oath taken before one year after its enactment. Approved October 5, 1962.
