PUBLIC LAW 95-561—NOV. 1, 1978 "(11) provide that special assistance be given to the needs of persons with limited English proficiency (as defined in section 703 (a) of title VII of the Elementary and Secondary Education Act of 1965) by providing a bilingual adult education program of instruction in English and, to the extent necessary to allow such persons to progress effectively through the adult education proram, in the native language of such persons, carried out in coorination with programs of bilingual education assisted under title VII and b i l i n ^ a l vocational education programs under the Vocational Education Act of 1963; "(12) demonstrate that the special educational needs of adult immigrants in the State have been examined, and provide for the implementation of adult education and adult basic education programs for immigrants to meet existing needs; "(13) set forth the criteria by which the State will evaluate the quality of proposals from local agencies, organizations, and institutions; and "(14) provide such further information and assurances as the Commissioner may by regulation require, including information regarding the extent to which the goals of the program have been achieved during the preceding three years. " (c) The Commissioner shall not finally disapprove any State plan submitted under this title, or any modification thereof, without first affording the State educational agency reasonable notice and opportunity for a hearing.".

SEC. 1306. Section 307 of the Act is amended to read as follows; ii

PAYMENTS

"SEC. 307. (a) The Federal share of expenditures to carry out a Federal share. State plan shall be paid from a State's allotment available for grants 20 USC 1206. to that State. The Federal share shall be 90 per centum of the cost of carrying out the State's programs, except that with respect to Guam, American Samoa, the Virgin Islands, the Northern Mariana Islands, and the Trust Territory of the Pacific Islands, the Federal share shall be 100 per centum. "(b) No payment shall be made to any State from its allotment for any fiscal year unless the Commissioner finds that the fiscal effort per student or the amount available for expenditure by such State for adult education from non-Federal sources for the preceding fiscal year was not less than such fiscal effort per student or such amount available for expenditure for such purposes from such sources during the second preceding fiscal year, but no State shall be required to use its funds to supplant any portion of the Federal share.".
