PUBLIC LAW 97-252—SEPT. 8, 1982 former spouse of a member or former member of the uniformed services only if the final decree of divorce, dissolution, or annulment of the marriage of the former spouse and such member or former member is dated on or after the effective date of such amendments, (e) For the purposes of this section— (1) the term "court order" has the same meaning as provided in section 1408(a)(2) of title 10, United States C!ode (as added by section 1002 of this title); (2) the term "former spouse" has the same meaning as provided in section 1408(a)(6) of such title (as added by section 1002 of this title); and (3) the term "uniformed services" has the same meaning as provided in section 1408(a)(7) of such title (as added by section 1002 of this title). TITLE XI—GENERAL PROVISIONS TRANSFER AUTHORITY

Notification to Congress.

SEC. 1101. (a)(1) Upon determination by the Secretary of Defense that such action is necessary in the national interest, the Secretary may transfer amounts of authorizations made available to the Department of Defense in this Act between any such authorizations (or any subdivisions thereof). Amounts of authorizations so transferred shall be merged with and be available for the same purposes as the authorization to which transferred. (2) The total amount of authorizations that the Secretary of Defense may transfer under the authority of this section may not exceed $1,500,000,000. (b) The authority provided by this section to transfer authorizations— (1) may only be used to provide authority for higher priority items than the items from which authority is transferred; and (2) may not be used to provide authority for an item that has been denied authorization by Congress. (c) The Secretary of Defense shall promptly notify Congress of transfers made under the authority of this section. WAIVER OP AUTHORIZATION REQUIREMENT FOR CERTAIN PREVIOUSLY APPROPRIATED FUNDS

SEC. 1102. The provisions of section 138(a) of title 10, United States Code, providing that funds may not be obligated or expended by the Armed Forces for certain purposes unless such funds have been specifically authorized by law shall not apply with respect to the obligation or expenditure of funds appropriated for fiscal year 1982 before the date of enactment of this Act for the following purposes: (1) Procurement of aircraft for the Army. (2) Procurement of aircraft for the Air Force. (3) Procurement of missiles for the Air Force. (4) Operations and maintenance for Defense-wide activities. SEC. 1103. Section 138(g) of title 10, United States Code, is amended—
