Article VIII

Health and Support Services

Sec. 23. Universal Access to HIV/STD/AIDS Health Care Services. Access to HIV/AIDS/STD health care services/assistance shall be extended to all individuals regardless of sex, gender, social status, political belief, tradition and religion.

Sec. 24. Adherence to Quality Health Care and Ethics of Care. Medical practitioner or other staff assisting or directly providing health services/examination/education to clients shall adhere to the basic principles of ethics of care. They shall also be sensitive to gender and sexual orientation in their treatment to patients/clients informing them their rights, including the right to life, and charges for abuses committed against him/her.

Sec. 25. Special Support Services for Pregnant Women, Senior Citizens, and Persons With Disability (PWD) with HIV/STD/AIDS. The LGU shall provide special care and support services for pregnant women with HIV/STD/AIDS.

Sec. 26. Health Care Plans for Persons with HIV/STD/AIDS. The Municipal Government in coordination with the Philippine National AIDS Council, Department of Health and Commissioner of Insurance shall conduct a feasibility study of setting up a package of health care plans and shall be the study warrant, implement the plan for HIV person.

Article IX

Discriminatory Acts and Confidentiality of Information

Sec. 27. Discriminatory Acts. Discriminatory in any form and place of person perceived of suspected HIV/STD/AIDS (i.e. employment process, promotion, assignment or termination from work, school, hospitals, health institutions, travel and habitation) shall be unlawful. Any act of discrimination related to this Ordinance shall be penalized under R.A. 8504.

Sec. 28. Prohibition Against Divulging of Confidential Information of Person with STD/HIV/AIDS. Any person who divulge confidential information about the HIV status of a person shall be penalized under R.A. 8504.

Article X Penal Provisions

Sec. 29. Penalty. Upon discretion of the court, any person found guilty of violating any provision of this Ordinance shall be meted with the following penalties:

a. First Offense - a fine of Php1,000.00;

b. Second Offense - a fine of Php1,500.00;

c. Third Offense - a fine of Php2,500.00 plus imprisonment of not less than three (3) months but not exceeding to six (6) months.

In case the violator is business establishment:

a. First Offense - a fine of Php1,000.00;

b. Second Offense - a fine of Php1,500.00;

c. Third Offense - a fine of Php2,500.00 plus imprisonment of not less than three (3) months but not exceeding to six (6) months upon the discretion of the court and cancellation and revocation of his/her business permit.
