Announcement Revising the Stipulations of Section 34
of the Charter of the Courts of Justice, 127 RE


There is a great royal command from Phra Bat Somdet Phra Paramin Maha Prajadhipok Phra Pokklao Chaoyuhua declaring to all that it be announced for general knowledge as follows:

In regard to the stipulations of section 34 of the Charter of the Courts of Justice, 127 RE, as amended by the Announcement Merging Public Prosecutors, 2458 Buddhist Era, which contain "in appointing a public prosecutor, if he be the Director General, Department Chief, Department Permanent Secretary, provincial prosecutor, or circle prosecutor, he shall be selected and appointed by the Minister upon His Majesty's command, or if he be a different public prosecutor, he shall be selected and appointed by the Director General or Chief of the Public Prosecutor Department upon the Minister's approbation", He entertains an opinion that, in order to enable the public service in this field proceed in a more smooth and expeditious manner, the Minister in charge should be allowed to order appointment of a public prosecutor other than the Director General or a circle prosecutor without having to apply for His permission.

Therefore, He orders with His gracious pleasure that the stipulations of section 34 of the Charter of the Courts of Justice be altered to be the following:

Section34.In appointing a public prosecutor, if he be the Director General or a circle prosecutor, he shall be selected and appointed by the Minister in charge upon His Majesty's command. Other than this, the selection and appointment shall be made by the Director General of the Public Prosecution Department upon the Minister's approbation.
