Given on the 5th day of December 2489 BE
Being the 2nd year of the present reign

Whereas it is appropriate to amend the transitory provisions of the Constitution of the Kingdom of Thailand (Interim) dated 9 November 2490 Buddhist Era, so as to allow the election of Members of the Chamber of Deputies in the initial period to proceed in a proper manner;

Therefore, with the approval of the National Assembly, the Monarch gives a great royal command that a Constitution Amendment be enacted as follows:

Section1.This Constitution is called the "Constitution of the Kingdom of Thailand (Interim) Amendment, 2490 BE".

Section2.This Constitution shall come into force from the day following the day of its publication in the Government Gazette onwards.

Section3.The stipulations of section 97 of the Constitution of the Kingdom of Thailand (Interim) dated 9 November 2490 Buddhist Era shall be repealed and replaced by the following stipulations:

"Section97.In the initial period, the election of Members of the Chamber of Deputies shall be conducted using the standard number of one Member of the Chamber of Deputies per two hundred thousand people according to the latest census. If the number of the people in any province is less than two hundred thousand, there shall be one Member of the Chamber of Deputies elected in that province. If the number of the people in any province is over two hundred thousand, there shall be one additional Member of the Chamber of Deputies elected in that province per every two hundred thousand inhabitants. A surplus of two hundred thousand shall, if reaching or exceeding one hundred thousand, be counted as two hundred thousand. In addition, the method of combination of provincial areas shall be used as the procedure for the election.

In conducting the election in this initial period, the provisions of the 'Elections Act, 2475 BE' Amendment (No. 3), 2479 Buddhist Era, and the amendments which are to be made, shall apply. However, the age of the election candidates according to the stipulations of section 16(1) of the 'Elections Act, 2475 BE' Amendment (No. 3), 2479 Buddhist Era, shall be designated to be not less than full thirty-five years, and the prohibition according to the stipulations of section 17(1) of such act shall also be excluded.

Once the election in the initial period has taken place, if a position of Member of the Chamber of Deputies becomes vacant for any other reason than retirement upon expiry of the Chamber or dissolution of the Chamber, and a replacing Member is to be elected, then the provisions of the previous paragraph shall apply."
