דיני סוכה שתחת סוכה |
628:1[edit]Regarding a sukkah that is underneath another sukkah, the top one is valid and the bottom one is invalid. This is so if the bottom one is able to support pillows and blankets of the upper one, even with difficulty, and there are ten tefachim between them. However, if there are not ten tefachim between them or there are ten tefachim between them but it is impossible [for the roof of the lower one] to support pillows and mattresses of the upper one, even with difficulty, the bottom one is valid if it is covered according to the law, even if the upper sukkah is higher than twenty tefachim. If it is not properly covered and is valid due to the schach of the upper one, the schach of that upper sukkah cannot be higher than twenty amot off the ground. |
סעיף א סוכה שתחת סוכה העליונה כשרה והתחתונה פסולה והני מילי שיכולה התחתונה לקבל כרים וכסתות של עליונה ואפי' ע"י הדחק ויש ביניהם עשרה טפחים אבל אם אין ביניהם י' טפחים או שיש ביניהם עשרה טפחים אבל אינה יכולה לקבל כרים וכסתות של עליונה אפי' ע"י הדחק התחתונה כשרה אם היא מסוככת כהלכתה אפילו אם העליונה למעלה מעשרים ואם אינה מסוככת כהלכתה ומתכשרת על ידי סכך העליונה צריך שלא יהא סכך העליונה גבוה מן הארץ למעלה מעשרים אמה: |
628:2[edit]If a sukkah is constructed upon a wagon or upon a boat, if it cannot withstand ordinary land winds it is invalid. However, if it can withstand ordinary land winds, even if it cannot withstand ordinary sea winds, it is valid. |
סעיף ב העושה סוכתו בראש העגלה או בראש הספינה אם אינה יכולה לעמוד ברוח מצויה דיבשה פסולה אבל אם יכולה לעמוד ברוח מצויה דיבשה אפילו אם אינה יכולה לעמוד ברוח מצויה דים כשרה: |
628:3[edit]If it is built on a camel or on top of a tree, it is valid, though one may not climb up to it on the festival. If it is partially on a tree and partially on something else such that if the tree was removed, it would remain standing without falling, one may climb up to it on the festival. If not, one may not climb up to it on the festival. |
