Cb^imber of London, In cafe any De- fect of Paving, how to be re- dreffcd. tbe^Owners'or Others interefted of or in fuch Houfes, Tofts of Ground unbuilt, and other Hereditaments whereof there {hall be no prefent Occupier. VIII. And where any Church or Church-yard fhall be fronting and adjoining to any of the faid Streets, Lanes or Paffages, to rate and aflefs a reafonable Proportion thereof upon the Parifh thereunto belonging, the fame to be paid by the Churchwardens of every fuch Parifli for the Time being, who are hereby re- quired to pay the fame accordingly in the Behalf of the faid Pat ifn : (2) Of which AireiFments the faid Deputies and Common-Council -IVIen fhall return Duplicates in Writing, together with the N:;mes of the Scavengers to be appointed for the ColleAion thereof, within twenty Days next after the Receipt of fuch Precept or Warrant refpeclively ; and in Cafe of their Neglect or Default in rating or afTefTmg the fame, or in returning fuch Duplicates of their Afleffments within the Time limited as aforefaid, it fliall and may be lawful to and for the laid Perfons fo to be authorized and appointed, or any feven or more of them, to rate and affefs the refpedlive Taxes and AiTeffinents within the .feveral Wards and Precindts where fuch Defaults -fhall be, upon the refpeftive Inhabitants and others, in Manner as aforefaid ; (3) all which Sum and Sums of Money fo to be rated and aflefled in Purfuance of this A<S1:, fhall from Time to Time be collected aad levied by the Scavengers to be appointed for the colledting thereof as aforefaid, who are hereby authorized and required to colle<3: and levy the fame accordingly; and in Default of Payment of the Sums to be charged and affeffed as aforefaid, or any Part thereof, by the Space of fix Days after Demand thereof, it fhall and may be lawful to and for the faid Scavengers to be appointed for the colledling and levying thereof as aforefaid, and they are hereby authorized and required thereunto, to levy all fuch Sum and Sums of Money fo aflelTed, by Diftrefs and Sale of the Goods of the Parties refufing or neglefting to pay the fame, rendiing the Overplus, if any fhall be, befides the reafonable Charge of taking fuch Diitrefs, to the Party or Parties fo diftrained. IX. All which Sum and Sums of Money, from Time to Time, hereafter to be colle£l:ed and levied by Virtue of this prefent A6f, fhall be paid into the Chamber of the City of Lo?ido7i, by the faid Scavengers who fhall colle<£l; the fame rcfpectively, where Books of Accounts fhall be kept of the Receipt thereof, by the Chamberlain of the faid City o( Loizdon for the Time being : (2} And no Monies fhall be ilTued there- out, otherwife than by Order or Warrant under the Hands of the faid Perfons fo to be appointed and au- thorized as aforefaid, or any feven or more of them, for the Ufes and Purpofes in and by this Act mention- ed and appointed. X. And it is hereby further ena(5ted. That where any Citizen or Inhabitant within the faid City or Li- berties thereof fhall find himfelf aggrieved through the Defeat or Decay of the Pavements in any of the faid Streets, Lanes or Paffages within the faid City or Liberties thereof, or for want of due cleanfing thereof, the fame being made appear to the Perfons fo to be authorized and appointed by the faid Mayor, Aldermen and Commons as aforefaid, or any feven or more of them, at their publick Meeting, and upon due Proof made, that fuch Grievance is unreformed ; that then and in fuch Cafe the Perfon and Perfons complaining fhall forthwith receive the Order and Directions of the faid Perfons fo authorized and appointed, or any feven or more of them, for redreffing thereof, together with a Warrant under their Hands and Seals, di- re£ted to the Chamberlain of the City of London for the Time being, to ifllie out Monies for defraying the The Profecutor Charge thereof, together with any Sum of Money, not exceeding ten Shillings, for Encouragement of his encourage . ^^ their Diligence therein, who, upon Receipt of fuch Warrant, fhall pay the fame accordingly. Layftalstobe XI. And be it enafted by the Authority aforefaid. That it fhall and may be lawful to and for the faid provided for Mayor, Aldermen and Commons in Common Council aflembled, to appoint, fet out and purchafe for the the Drr"'&c. publick Ufe and Benefit of the faid City of London^ in Places convenient, and where the fame may be leaft ^ Annoyance, fuch and fo many Pieces or Parcels of Ground for Layftals and Places for publick Stores, as they ftiall adjudge necefiary and convenient for the Receipt of the Soil, Dirt and Rubbifh, which fhall be removed and carried out of the faid City and Liberties thereof, as for other Materials and Commodities. XII. And that all fuch Pieces of Ground for Layftals and Places for publick Stores, as by them fhall be purch-jfed as aforefaid, fhall be fatisfied and paid for out of the Monies raifed or hereafter to be raifed by the Impofition upon Coals, appointed for publick Ufes of the faid City, by Virtue of the faid Adt for rebuilding the City, and of another Adt, intituled, Jn Jdditioncl J^ for Rehutldlng of the City of London, Uniting^ Parljhcs, end Rehuld'ing of the Cathedral and Parochial Churches -within the [aid City, (other than the Money appointed for building of the Cathedral Church of St. PauFs, and other Churches within the faid City, and referving fufficient to fatisfy fuch Perfons whofe Grounds have been taken from them) or either of them; anv Law or Statute to the contrary the' eof in any wife notwithftanding. XIII. And in cafe that any Perfon or Perfons fhall find him or themfelves aggrieved by Reafon of any Tax, Affeffment, or ether Charge to be impofed by Virtue or Colour of this prefent Aft; That then it (hall and may be lawful to and for the Parl^ or Parties fo aggrieved, within five Days after Demand thereof, to appeal to the Mayor and Court rf Aldermen of the faid City for the Time being, for Redrcfs therein, whofe Order in that Behalf ihall be final. XIV. Provided always, and it is hereby declared. That no Perfon or Perfons, Bodies Politick or Corpo- rate, who by this Ail are made liabl? to be rated or afl'efTed towards the publick Charge of altering, enlarg- ing, amejiding, or cleanfing of the faid Vaults, or Sewers, or of cleanfing, pitching or paving the Streets, Lanes, Alleys, and other common Paffages within the faid City and Liberties thereof, for or in refpeift of any Houfes, Tofts, or other Hereditaments, {hall from and after the firft Day of May one thoudind fix £:c. to be further hundred ftvcnty-one, be otherwife charged therewith, or liable thereunto, or to be troubled, mole{led, or chargeable. profecutcd for or in RefpciSt thereof ; any other Law, Statute, Cuftom, or Ufage to the contrary notwith- {tanding-.
