12 2 STA T .3 2 05PUBLIC LA W 110 – 315 — AU G .1 4, 200 8‘ ‘ (A)besu b mit te dno t la te r t h an 12 months a f ter the eli g ible entities re c ei v ing funds under this cha p ter are re q uired to report their performance to the S ecretar y; ‘‘( B ) focus on the programs ’ performance on the rel - evant outcome criteria determined under section 40 2A(f)(4); ‘‘( C ) aggregate individual pro j ect performance data on the outcome criteria in order to provide national perform- ance data for each program; ‘‘( D ) include ,w hen appropriate, descriptive data, multi- year data, and multi-cohort data; and ‘‘( E ) include comparable data on the performance nationally of low-income students, first-generation stu- dents, and students with disabilities . ‘‘(2) INFORMATI ON. —T he Secretary shall provide, with each report submitted under paragraph (1), information on the impact of the secondary review process described in section 402A(c)( 8 )(C)(iv), including the number and type of secondary reviews, the disposition of the secondary reviews, the effect on timing of awards, and any other information the Secretary determines is necessary.’’; and (4) in subsection (b) (as redesignated by paragraph (2)), by stri k ing paragraphs (1) and (2) and inserting the following

‘‘(1) IN GE NERA L .— ‘‘(A) A U T H ORI Z ATION OF GRANT S AN DC ONTRACTS.— F or the purpose of improving the effectiveness of the programs and projects assisted under this chapter, the Secretary shall make grants to, or enter into contracts with, institu- tions of higher education and other public and private institutions and organi z ations to rigorously evaluate the effectiveness of the programs and projects assisted under this chapter, including a rigorous evaluation of the pro- grams and projects assisted under section 402C. The evaluation of the programs and projects assisted under section 402C shall be implemented not later than J une 3 0, 2010. ‘‘(B) CONTENT OF U PW ARD B OUND E V ALUATION.—The evaluation of the programs and projects assisted under section 402C that is described in subparagraph (A) shall e x amine the characteristics of the students who benefit most from the U pward Bound program under section 402C and the characteristics of the programs and projects that most benefit students. ‘‘(C) IMPLEMENTATION.—Each evaluation described in this paragraph shall be implemented in accordance with the requirements of this section. ‘‘(2) P RACTICES.— ‘‘(A) IN GENERAL.—The evaluations described in para- graph (1) shall identify institutional, community, and pro- gram or project practices that are effective in— ‘‘(i) enhancing the access of low-income individuals and first-generation college students to postsecondary education; ‘‘(ii) the preparation of such individuals and stu- dents for postsecondary education; and ‘‘(iii) fostering the success of the individuals and students in postsecondary education.
