Provided, That funds appropriated under this heading may be made available on such terms and conditions as the USAID Administrator may determine, in consultation with the Committees on Appropria- tions, for the purposes of preventing or responding to such crises, except that no funds shall be made available to respond to natural disasters: Provided further, That funds appropriated under this heading shall be made available notwithstanding section 10 of P ublic L aw 91 – 6 72 and section 15 of the State Department B asic Authorities Act of 1956: Provided further, That the USAID Adminis- trator may furnish assistance under this heading notwithstanding any other provision of law, except sections 7007, 700 8 , and 7018 of this Act and section 620 J of the Foreign Assistance Act of 1961: Provided further, That funds appropriated under this heading shall be subject to the regular notification procedures of the Committees on Appropriations, except that such notifications shall be transmitted at least 5 days in advance of the obligation of funds: Provided further, That the re q uirements of the previous proviso may be waived if failure to do so would pose a substantial ris k to human health or welfare: Provided further, That in case of any such waiver, notification to the Committees on Appropria- tions shall be provided as early as practicable, but in no event later than 3 days after taking the action to which such notification requirement was applicable, in the context of the circumstances necessitating such waiver: Provided further, That any such notifica- tion provided pursuant to such waiver shall contain an explanation of the emergency circumstances. DE V ELOPMEN T CREDIT A UT H ORIT Y( INCLUDIN G TRANSFER OF FUNDS ) For the cost of direct loans and loan guarantees provided by the United States Agency for International Development, as author- i z ed by sections 256 and 635 of the Foreign Assistance Act of 1961, up to $25,000,000 may be derived by transfer from funds appropriated by this Act to carry out part I of such Act and under the heading ‘ ‘Assistance for E urope, Eurasia and Central Asia ’ ’: Provided, That funds provided under this paragraph and funds provided as a gift pursuant to section 635(d) of the Foreign Assist- ance Act of 1961 shall be made available only for micro and small enterprise programs, urban programs, and other programs which further the purposes of part I of such Act: Provided further, That such costs, including the cost of modifying such direct and guaran- teed loans, shall be as defined in section 502 of the Congressional Budget Act of 197 4 , as amended: Provided further, That funds made available by this paragraph may be used for the cost of Notif i ca tio n.
