MUNICIPAL ORDINANCE NO. 17 –2022

Ordinance Requiring the Installation of Closed-Circuit Television System (CCTV) for Certain Business Establishments as a Requisite for the Renewal of Issuance of Business Permits and Providing Penalties for Violation Thereof
WHEREAS, Memorandum Circular No. 2022 - 060 of the Department of Interior and Local Government (DILG) urged cities and municipalities to enact Ordinances to install Closed-Circuit Television System (CCTV) in business establishments catering to a large number of customers and to those which are risk or hazard prone;
WHEREAS, Sec 16 of R.A. 7160 or otherwise known as Local Government Code of the Philippines states that “every Local Government Unit shall exercise powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare and maintain peace and order”;
WHEREAS, Sections 447 and 458 of the said R.A. 7160 provide in part, that the Sangguniang Bayan shall enact ordinances for the general welfare of the municipality and its inhabitants pursuant to the abovementioned Section 16 of said law, and in this regard, enact and approve ordinances relative to the: (i) maintenance of peace and order in the municipality, (ii) suppression of lawlessness therein, (iii) authorization of the issuance of permits or licenses upon conditions and for such purposes intended to promote general welfare of the inhabitants of the municipality, regulating thereby any business which does not require government examination within the municipality and the conditions under which the license for said business may be issued or revoked;
WHEREAS, law enforcement agencies already proven that CCTV System are among the most effective tools in crime deterrence, prevention, detection and solution since there is a video recording which can be used in addition to the testimonies of the witnesses;
WHEREAS, the Department of Interior and Local Government, through the Philippine National Police Anti-Crime Group, has conducted a study as to the minimum technical specifications to be required of CCTV System to be installed pursuant to this ordinance;
