พระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดช มีพระบรมราชโองการโปรดเกล้าฯ ให้ประกาศว่า

Phra Bat Somdet Phra Paramin Maha Bhumibol Adulyadej has issued with his pleasure a great royal command that it be proclaimed as follows:

โดยที่เป็นการสมควรแก้ไขเพิ่มเติมกฎหมายว่าด้วยลิขสิทธิ์

Whereas it is appropriate to amend the law on copyright;

จึงทรงพระกรุณาโปรดเกล้าฯ ให้ตราพระราชบัญญัติขึ้นไว้ โดยคำแนะนำและยินยอมของสภานิติบัญญัติแห่งชาติ ดังต่อไปนี้

Therefore, he grants with his gracious pleasure, by and with the advice and consent of the National Legislative Assembly, the enactment of the following Act:

มาตรา⁠๑⁠พระราชบัญญัตินี้เรียกว่า "พระราชบัญญัติลิขสิทธิ์ (ฉบับที่ ๓) พ.ศ. ๒๕๕๘"

Section⁠1.⁠This Act is called the "Copyright Act (No. 3), 2558 BE".

มาตรา⁠๒⁠พระราชบัญญัตินี้ให้ใช้บังคับเมื่อพ้นกำหนดหกสิบวันนับแต่วันประกาศในราชกิจจานุเบกษาเป็นต้นไป

Section⁠2.⁠This Act shall come into force upon elapse of the period of sixty days reckoned from the date of its publication in the Government Gazette onwards.

มาตรา⁠๓⁠ให้เพิ่มความต่อไปนี้เป็นมาตรา ๒๘/๑ แห่งพระราชบัญญัติลิขสิทธิ์ พ.ศ. ๒๕๓๗

Section⁠3.⁠The following text shall be inserted in the Copyright Act, 2537 BE, as its section 28/1:

"มาตรา ๒๘/๑ การทำซ้ำโดยการบันทึกเสียงหรือภาพหรือทั้งเสียงและภาพจากภาพยนตร์อันมีลิขสิทธิ์ตามพระราชบัญญัตินี้ในโรงภาพยนตร์ตามกฎหมายว่าด้วยภาพยนตร์และวีดิทัศน์ ไม่ว่าทั้งหมดหรือแต่บางส่วน โดยไม่ได้รับอนุญาตตามมาตรา ๑๕ (๕) ในระหว่างการฉายในโรงภาพยนตร์ ให้ถือว่า เป็นการละเมิดลิขสิทธิ์ และมิให้นำมาตรา ๓๒ วรรคสอง (๒) มาใช้บังคับ"

"Section⁠28/1.⁠The reproduction by recording either the sound or picture of, or both the sound and picture of, a film copyrighted under this Act, whether in whole or in part, in a cinema under the law on films and videos, during its screening in the cinema, without having obtained the permission under section 15(5), shall be deemed to be an infringement of the copyright, and section 32, paragraph 2(2), shall not apply."

มาตรา⁠๔⁠ให้เพิ่มความต่อไปนี้เป็น (๙) ของวรรคสอง ของมาตรา ๓๒ แห่งพระราชบัญญัติลิขสิทธิ์ พ.ศ. ๒๕๓๗

Section⁠4.⁠The following text shall be inserted in the Copyright Act, 2537 BE, as (9) of paragraph 2 of its section 32:

"(๙)⁠ทำซ้ำ หรือดัดแปลง เพื่อประโยชน์ของคนพิการที่ไม่สามารถเข้าถึงงานอันมีลิขสิทธิ์ อันเนื่องมาจากความบกพร่องทางการเห็น การได้ยิน สติปัญญา หรือการเรียนรู้ หรือความบกพร่องอื่นตามที่กำหนดในกฎกระทรวง โดยต้องไม่เป็นการกระทำเพื่อหากำไร ทั้งนี้ รูปแบบของการทำซ้ำหรือดัดแปลงตามความจำเป็นของคนพิการ และองค์กรผู้จัดทำ รวมทั้งหลักเกณฑ์และวิธีการดำเนินการเพื่อทำซ้ำหรือดัดแปลง ให้เป็นไปตามที่รัฐมนตรีประกาศกำหนดในราชกิจจานุเบกษา"

"(9)⁠the reproduction or adaptation in the interest of a disabled person incapable of access to a copyrighted work on account of vision, hearing, intellectual, or learning impairment or such other impairments as prescribed in ministerial regulations, without a view to seeking profit; in this respect, the forms of the reproduction or adaptation as necessary for disabled persons and the entities to carry out [the reproduction or adaptation], as well as the criteria and procedure for the carrying out of the reproduction or adaptation, shall be as prescribed and published in the Government Gazette by the Minister".

มาตรา⁠๕⁠ให้เพิ่มความต่อไปนี้เป็นมาตรา ๖๙/๑ แห่งพระราชบัญญัติลิขสิทธิ์ พ.ศ. ๒๕๓๗

Section⁠5.⁠The following text shall be inserted in the Copyright Act, 2537 BE, as its section 69/1:

"มาตรา ๖๙/๑ ผู้ใดกระทำการละเมิดลิขสิทธิ์ตามมาตรา ๒๘/๑ ต้องระวางโทษจำคุกตั้งแต่หกเดือนถึงสี่ปี หรือปรับตั้งแต่หนึ่งแสนบาทถึงแปดแสนบาท หรือทั้งจำทั้งปรับ"

"Section⁠69/1.⁠Anyone who commits an infringement of a copyright according to section 28/1 incurs a penalty of imprisonment from six months to four years, or fine from one hundred thousand baht to eight hundred thousand baht, or both such imprisonment and fine."

หมายเหตุ :- เหตุผลในการประกาศใช้พระราชบัญญัติฉบับนี้ คือ เนื่องจากปัจจุบันมีปัญหาการทำซ้ำโดยการบันทึกเสียงหรือภาพ หรือทั้งเสียงและภาพ จากภาพยนตร์ในระหว่างการฉายในโรงภาพยนตร์ ทั้งภาพยนตร์ไทยและภาพยนตร์ต่างประเทศ โดยไม่ได้รับอนุญาต แล้วนำไปทำซ้ำในสื่อต่าง ๆ เช่น แผ่นซีดี หรือแผ่นดีวีดี เป็นต้น ออกจำหน่าย สร้างความเสียหายทางเศรษฐกิจต่ออุตสาหกรรมภาพยนตร์และธุรกิจที่เกี่ยวเนื่องเป็นอย่างมาก ซึ่งเป็นการขัดต่อการแสวงหาประโยชน์จากงานอันมีลิขสิทธิ์ตามปกติของเจ้าของลิขสิทธิ์หรือผู้ได้รับอนุญาตให้ใช้สิทธิ และอาศัยข้อยกเว้นการละเมิดลิขสิทธิ์ตามกฎหมายว่าด้วยลิขสิทธิ์ในปัจจุบัน โดยอ้างว่า เป็นการทำซ้ำเพื่อประโยชน์ของตนเอง จึงสมควรแก้ไขเพิ่มเติมพระราชบัญญัติลิขสิทธิ์ พ.ศ. ๒๕๓๗ โดยกำหนดให้การกระทำละเมิดลิขสิทธิ์ในลักษณะดังกล่าวเป็นความผิดเฉพาะ และมีอัตราโทษเช่นเดียวกับการกระทำละเมิดลิขสิทธิ์เพื่อการค้า นอกจากนี้ สมควรกำหนดข้อยกเว้นการละเมิดลิขสิทธิ์เพิ่มเติม เพื่อประโยชน์ของคนพิการทางการมองเห็น คนพิการทางการได้ยิน คนพิการทางสติปัญญา และคนพิการประเภทอื่นที่กำหนดในพระราชกฤษฎีกา ที่จะสามารถเข้าถึงงานอันมีลิขสิทธิ์ได้ตามความจำเป็น จึงจำเป็นต้องตราพระราชบัญญัตินี้

Note: The grounds for promulgation of this Act are as follows: At present, there are problems of reproducing [copyrighted works] by recording without permission either sound or picture or both sound and picture of films, either Thai or foreign, during their screening in cinemas, and reproducing them in various media, as CDs or DVDs, for instance, for further disposal,[1] causing considerable economical damage to the film industry and related businesses, to the detriment of the ordinary exploitation of copyrighted works by the owners of the copyrights or the persons permitted to use the rights. Moreover, [the offenders] avail themselves of the exceptions to copyright infringement under the present law on copyright to assert that the reproduction is for their personal use. It is thus appropriate to amend the Copyright Act, 2537 BE, by designating the commission of a copyright infringement in the said manner as a specific offence liable to the same penalty as that for an infringement of copyright for a commercial purpose. In addition, it is appropriate to provide an additional exception to copyright infringement in favour of persons with visual disability, persons with hearing disability, persons with intellectual disability, and persons with other types of disabilities as prescribed in a royal decree, so that they would be able to access copyrighted works as necessary. It is therefore necessary to enact this Act.
