Decision of the First Session of the Tenth National People's Congress on the Plan for Restructuring the State Council

(Adopted at the First Session of the Tenth National People's Congress on March 10, 2003)

The First Session of the Tenth National People's Congress, having heard the explanations made by Wang Zhongyu, State Councillor and Secretary-General of the State Council, regarding the plan for restructuring the State Council and deliberated the plan, decides to approve it.

Appendix:

Plan for Restructuring the State Council

According to the task put forward at the Sixteenth Central Committee of the Communist Party of China for deepening the reform of the administrative system and the Opinion on Deepening the Reform of the Administrative System and the Institutional Restructuring adopted upon deliberation at the Second Plenary Session of the Sixteenth Central Committee of the CPC, the current tasks of the State Council for restructuring are chiefly:

(1) To deepen the structural reform of State-owned assets administration, by establishing a State-owned Assets Supervision and Administration Commission under the State Council;

(2) to improve the macro-economic control system by reorganizing the State Development Planning Commission into the National Development and Reform Commission;

(3) to improve the financial supervision and administration system by establishing the China Banking Regulatory Commission;

(4) to continue promoting the reform of the circulation administration system by establishing the Ministry of Commerce;

(5) to strengthen the supervision and administration system for food safety and safe production by establishing the State Food and Drug Administration on the basis of the State Drug Administration and turning the State Administration of Work Safety under the State Economic and Trade Commission into a department directly under the State Council;

(6) to rename the State Family Planning Commission the State Population and Family Planing Commission; and

(7) to stop retaining the State Economic and Trade Commission and the Ministry of Foreign Trade and Economic Cooperation.

After restructuring, there will be the following component departments of the State Council, in addition to the General Office of the State Council:

  1. the Ministry of Foreign Affairs of the People's Republic of China;
  2. the Ministry of National Defense of the People's Republic of China;
  3. the National Development and Reform Commission of the People's Republic of China;
  4. the Ministry of Education of the People's Republic of China;
  5. the Ministry of Science and Technology of the People's Republic of China;
  6. the Commission of Science, Technology and Industry for National Defense of the People's Republic of China;
  7. the State Ethnic Affairs Commission of the People's Republic of China;
  8. the Ministry of Public Security of the People's Republic of China;
  9. the Ministry of State Security of the People's Republic of China;
  10. the Ministry of Supervision of the People's Republic of China;
  11. the Ministry of Civil Affairs of the People's Republic of China;
  12. the Ministry of Justice of the People's Republic of China;
  13. the Ministry of Finance of the People's Republic of China;
  14. the Ministry of Personnel of the People's Republic of China;
  15. the Ministry of Labour and Social Security of the People's Republic of China;
  16. the Ministry of Land and Resources of the People's Republic of China;
  17. the Ministry of Construction of the People's Republic of China;
  18. the Ministry of Railways of the People's Republic of China;
  19. the Ministry of Communications of the People's Republic of China;
  20. the Ministry of Information Industry of the People's Republic of China;
  21. the Ministry of Water Resources of the People's Republic of China;
  22. the Ministry of Agriculture of the People's Republic of China;
  23. the Ministry of Commerce of the People's Republic of China;
  24. the Ministry of Culture of the People's Republic of China;
  25. the Ministry of Health of the People's Republic of China;
  26. the State Population and Family Planing Commission of the People's Republic of China;
  27. the People's Bank of China; and
  28. the National Audit Office of the People's Republic of China.

In accordance with the provisions of the Organic Law of the State Council, readjustment and establishment of the component departments of the State Council shall be subject to examination and approval by the National People's Congress. The establishment of the State-owned Assets Supervision and Administration Commission, the China Banking Regulatory Commission and the State Food and Drug Administration and the readjustment of the structure of the State Administration of Work Safety shall be subject to examination and approval by the newly formed State Council.
