Luckenbach Steamship Company  v.  United States


The judgment of the United States District Court for the District of Delaware, so far as it relates to the suspension of rates phase of the dispute, is vacated and the case is remanded to the District Court with instructions to dismiss the cause as moot. United States v. Amarillo-Borger Express, 352 U.S. 1028, 77 S.Ct. 594, 1 L.Ed.2d 598; Atchison, T. & S. F. R. Co. v. Dixie Carriers, 355 U.S. 179, 78 S.Ct. 258, 2 L.Ed.2d 186. With respect to the antitrust phase of the dispute, the judgment of the District Court is affirmed.
