ADOPTION OF CHILDREN.

CHAPTER 6.

APPEARANCE BY INSTRUMENT IN WRITING.

AN ACT To Amend Section 112 of the Civil Code relating to the Adoption of Children.

Ве it Enacted by the Legislative Assembly of the Territory of Dakota:

§ 1. That section 112 of the Civil Codeis amended to read as fellows:

§ 112. Adopted by written instrument.] The person adopting а child, and the child adopted, and the other person whose censent is necessary must appear before the probate judge of the county where the person adopting resides, and the necessary consent must thereupon be filed, and an agreement be executed by the person adopting, and filed with the probate court to the effect that the child shall be adopted and treated in all respects as his own lawful child should be treated: Provided, That the appearance, by an instrument in writing duly executed and acknowledged, may be entered by any person, except the child, whose consent is necessary.

§ 2. This act shall take effect from and after its passage and approval.
