These consolidated appeals from an order of the High Court of Australia raise questions of great constitutional importance upon which the Judges of that Court were not able to agree. This has had for their Lordships the advantage that both sides of case have been presented with the cogency and clarity which distinguish The judgments of the Court, an advantage the more valuable because they have not had the assistance of argument by counsel for the respondents.
The constitutional issues that arise can best be understood if the relevant facts are first briefly stated.
The respondents, the Boilermakers' Society of Australia, which will be called ethe Union, is an organisation of employees registered in accordance with the provisions of the Conciliation and Arbitration Act, 1904–1952, a Federal Act which will be referred to as the Act. The Metal Trades Employers' Association is an organisation of employers similarly registered. On the 16th January, 1952, an award was made under the Act binding
