Customs and Excise Service Ordinance

1. Ordinances referred to in sections 17 and 17A

Schedule 2 to the Customs and Excise Service Ordinance (Cap. 342) is amended by adding—

“Chemical Weapons (Convention) Ordinance (26 of 2003)”.

Organized and Serious Crimes Ordinance

2. Offences relevant to definitions of “organized crime” and “specified offence”

Schedule 1 to the Organized and Serious Crimes Ordinance (Cap. 455) is amended by adding—

19. Chemical Weapons
(Convention) Ordinance
(26 of 2003)
section 5 prohibition against using, developing or producing,
acquiring, stockpiling, retaining, participating in the
transfer of, engaging in military preparations, or in
preparations of a military nature, intending to use,
chemical weapons, or assisting, encouraging or
inducing anyone to engage in any activity prohibited
by the Convention on the Prohibition of the
Development, Production, Stockpiling and Use of
Chemical Weapons and on their Destruction, signed
at Paris on 13 January 1993”.

Weapons of Mass Destruction (Control of Provision of Services) Ordinance

3. Interpretation

Section 2(3) of the Weapons of Mass Destruction (Control of Provision of Services) Ordinance (Cap. 526) is repealed and the following substituted—

“(3) In subsection (1), “chemical weapon” (化學武器) has the same meaning as in section 2(1) of the Chemical Weapons (Convention) Ordinance (26 of 2003).”.
