  2. International Residential Code for One and Two-Family Dwellings (“IRC”);
  3. International Existing Building Code (“IEBC”);
  4. International Fire Code (“IFC”);
  5. International Plumbing Code (“IPC”);
  6. International Mechanical Code (“IMC”);
  7. International Fuel Gas Code (“IFGC”);
  8. International Performance Code for Buildings and Facilities (“ICCPC”);
  9. International Energy Conservation Code (“IECC”);
  10. International Private Sewage Disposal Code (“IPSDC”);
  11. International Wildland–Urban Interface Code (“IWUIC”)
  12. International Property Maintenance Code (“IPMC”);
  13. International Swimming Pool and Spa Code (“ISPSC”);
  14. International Zoning Code (“IZC”); and
  15. International Green Construction Code (“IGCC”).

ICC has registered copyrights in the 2009 and 2012 editions of the IECC, the 2012 and 2015 editions of the ISPSC, IZC, and IGCC, and the 2009, 2012, and 2015 editions of all of the other codes listed above. (ICC SUMF ¶¶ 21–22; Johnson Decl. Ex. 5; Defs. Resp. ¶¶ 21–22.)

On October 19, 2017, Defendants answered and counterclaimed for a declaratory judgment stating that UpCodes did not and does not infringe ICC’s copyrights. (See Dkt. Nos. 20–21.)
