Et decetero in brevibus Ultime prefentationis & Quare impedit adjudicentur dampna videlicet -fi. tempus femeftre tranfierit per impedimentum ali- cujus ita quod fi Epifcopus ecclefiam conferat & verus patronus ea vice prefentationem fuam amittat adjudicentur dampna ad'valdrera medietatis a eccle- the Couftefie, Tenants in Dower, for Term of Life, or for Years, or Hufbands, faintly have defended Pleas moved by them, .or againft them ; (2) becaufe the Judgements given in the King's Courts {hall not be adnulled by this Statute, the Judgement (hall ftand in his Force, until it be reverfed in the Court of the King as erroneous, if Errour be found; (3) or by Aflife of Darrein prefentment, or by Enqueft by a Writ of £htare impedit, if it be pafied, or be adnulled by Attaint, or Certification, which fhall be fredy. granted. (4) Arid from henceforth one Form of Pleading (hall be obferved among Juftices in Writs of Darrein Prefentment and tshtare impedit, in this Re- fpecl:, if the Defendant alledgeth Plenarty '-of the Church of his own Prefentation, the PFea fhall not fail by reafon of the Plenarty ; fo that the Writ be purchafed within fix Months, though he cannot re- cover his Prefentation within the fix Months. • (5), And fometimes when an Agreement is made between- many claiming one Advowfon, and inrolled before the Juftices in the Roll, or by Fine, in this Form, that one fhall. prefent the firfF 1 ime, and at the next Avoidance another, , and the third Time another; and fo-of- many; in cafe there be many. (6) And when onehath prefented, and had his Prefentation, -which He ought to have according to the Form of 'their Agreement and Fine, and at the next Avoidance he to whom the fecond Prefentation belongeth, is difturbed by any that was Party to the faid Pine, or ' by fome other in his Stead ; (7) it is provided, That from henceforth they that be fo difturbed fhall have noneed'to fue a §>uare impedit, but fhall refort to the Roll or Fine ; (8; and if the faid Concord or Agree- ment be found in the Roll or Fine, then the Sheriff fhall be commanded, that he give Knowledge unto the Difturber, that he be ready at fome fhort Day, containing the Space of Fifteen Days, or three Weeks (as the Place happeneth to be near or far) for to (hew. if he can alledge any Thing, wherefore the Party that is difturbed ought not to prefent: (9) And if he come not, or peradventure doth. come, and can al- ledge nothing to bar the Party of his Prefentation, by Reafon of any Deed made or written * fince the Fine was made or inrolled, he fhall recover his Prefenta- tion with his Damages. (10) And where it chanceth that after the Death of the Anceftor of him that pre- fented his Clerk unto a Church, the fame Advowfon is affigned in Dower to any Woman, or to- Tenant by the Curtefie, which do prefent, and after the Death of fuch Tenants the very Heir is difturbed to prefent when the Church is void, (11) it is provided, That from henceforth it (hall be in the Election. of the Party, difturhed, whether he will fac a Writ of Shiare impedit, or of Darrein presentment, The fame fhall be obferved in Advowfons demifed for Term of Life, or Years, or in Fee-tail. ' III. And from henceforth in Writs of <3>iiare Im- pedit. and Darrein Prefentment, Damages fhall be a- warded, that is to wit, If the Time of Rx Months pafs by the Difturbance of any, fo that the Bifhop do confer to the Church, and the very Patron lofeth his Prefentation for that Time, Damages fhall bs awarded for two Years Value of the Church.
