What Procefs fhall be awarded againft thofe that be appealed by Approvers. Cotton MS. Claudius, D. 2. CUM certi Juftic' in fingulis Comitatibus regni ad Affifas in eifdem capiend' de novo fint affignati fimulque ad liberationem gaola- rum eorundem Comitatuum in fingulis adventibus fuis faciend' poft captionem earundem Affifarum prout in ftatuto domini Regis inde confe&o ple- nius continetur. Dominus Rex ad Parliamentum fuum apud Weftm' anno regni fui vicefimo o£tavo pro pace firmius obfervanda feloniifque celerius convincend' & prifonibus citius deliberandis conceffit ordinavit & ftatuit quod quicumque fuerint appellati per probatores exiftentes in gaolis quas ipfi Juftic' de- liberant & ubicumque in regno ipfi appellati com- morantes fuerint aut latitantes quod ftatim man- detur Vic' in quorum balliva taliter appellati fue- rint commorantes aut poterint inveniri per breve domini Regis fub teftimonio eorumdem Juftic' quod taliter appellatos capiant & ducere faciant ad gaolas ubi appellatores per quos appellantur fuerint detenti & ibidem coram ipfis Juftic' refpondeant. Et ft ipfi appellati fe fuper patriam pofuerint fimi- liter mandetur per breve de judicio per eofdem Juftic' Vic' in cujus balliva felonie facie fuerint de ?uibus appellantur quod venire fac' coram eifdem uftic' inquifitionem patrie ad eundem locum ubi appellatores fint detenti & ad certum diem. Hereas certain Juftices of late were afligned 27 Ed. r. flat. x. to take Affifes in all Shires of the Realm, c - 3- and alfo to deliver the Gaols of the fame Shires at every of their Comings after the taking of fuch Affifes, as more plainly is contained in a Sta- tute made by the King thereupon ;" (2) ' our Lord the King, at his Parliament holden at Wejlniinjler, the eight and twentieth Year of his Reign, for more fure Obfervation of his Peace, and Felonies to be more quickly puniftied, and Prifoners to be fooner 2 H. 7. f. j. delivered, hath granted, ordained, and provided, That Fit*. Coron. whofoever be appealed by Provors, being in Prifons azl > 3 a2 > 3 8-r » which the fame Juftices do deliver (and wherefoever * + g* *g^* 44 ' 3 * in our Realm that fuch Appealees be dwelling*) that * AAA or lurking, immediately it fhall be commanded to the Sheriff, in whofe Bailiwick the Parties fo appealed be com- morant or may be found, by the King's Writ, un- der the Teftimony of the fame Juftices, that he do take fuch Perfons appealed, and caufe them to be brought unto the Gaols where the Appealors be kept that appealed them, and they fhall anfwer there be- fore the fame Juftices. (3) And if they that be ap- pealed will put themfelves upon the Country, it fhall be commanded in like manner by a Judicial Writ, from the fame Juftices to the Sheriff, in whofe Li- berty the Felonies were done, of which they were appealed, that he fhall caufe an Enquefc of the Country to come before the fame Juftices, unto the fame Place where the Appealors be kept, at a certain Day.
