CAP. X. Every Perfon that is impeached in the Exchequer, may plead in his own Difcharge. AAiJlat. TEM, Becaufe that grievous Complaint hath oftentimes been made of the Officers of the Ex- chequer, for that the Heirs, Executors, Occupiers of Goods, and Land Tenants of divers Perfons which have been impeached in the faid Exchequer, of Debts, Accompts, and other Demands, and which although they have offered them there to fhew, or plead for their Difcharge of thofe Impeachments according to the Law, they have not been always thereunto received heretofore, without having ex- prefs Commandment by Writ, or Letter of the Great or Privy Seal, to the great Difquietnefs, Mif- chief, and Delay of the faid Perfons impeached, and no Advantage to the King;" ' (2) it is ordained and aflented, That the Barons of the faid Exchequer fhall from henceforth have full Power to hear every Anfwer of every Demand made in the fame Exche- ' quer, fo that every Perfon that is impeached or im- peachable of any Caufe by himfelf, or by any Perfon, fhall be from henceforth received in the fame Exche- quer to plead, fue, and have his reafonable Difcharge in this Behalf, without tarrying or fuing any Writ, 4 inlt. no, or other Commandment whatfoever.' CAP. XL The Covenants of thofe that fhall ferve the King in his Wars or Embafiies fhall be put in Writing, and fent into the Exchequer. ITEM pur ce qe grantz mefchiefs ont efcheuz devant ces heures a diverfes perfones fibien a les Seignurs du Roialme come as autres qe furent re- tenuz ou affignez de fervir a noftre Seignur le Roi par endentures ou fanz endentures en fes guerres fes meffageries ou en autre manere & par celles caufes refcevrent certeins fommes de deniers a la refceite del dit efcheqier ou aillours par affignement les quelles fommes aient efte mifes fur eux es rolles del dit efcheqier come deniers refceuz par voie dap- preft & par tant celles fommes currerent en de- mande fur eux a lefcheqier come dette cler & com- bien qe les dites perfones enfi retenuz lours heirs executours occupiours des biens ou terre tenantz apres lour mort aient demandez pur eftre refceuz daccompter de les fommes refceuz ne pur quant ce nad mye efte a eux grantez einz ont efte con- ftreintz de purfuer lour garant de grant ou prive feal direft as Treforer & Barons illoeqes par quel fuft commandez as Treforer & Barons daccompter avec eux en celle partie les queux garantz meint- fqitz ont efte deniez a caufe qe les officers du Roi novellement creez par cas navoient coniflance de Vol. I. 4 |TEM, Becaufe that great Mifchiefs have hap- ' fi. pened in Times paft to divers Perfons, as well to Lords of the E.ealm, as other, which were retained or affigned to ferve our Lord the King by Indentures or without Indentures, in his Wars and his Mef- fages, or in other Manner, and for the fame Caufes receive certain Sums of Money at the Receipt of the ' faid Exchequer, or elfewhere by Alignment, which Sums have been put upon them in the Rolls of the faid Exchequer, as Money received by Way of Loan, and for that Caufe the fame Sums fhould run in De- mand upon them at the Exchequer as a clear Debt, although the faid Perfons fo retained, their Heirs, Executors, Occupiers of their Goods, or Land Te- nants, after their Death have demanded to be ad- mitted to Accompt of the Sums received, which hath not been granted to them, but they have been conftrained .to purfue their Grant * by the Great-or* Warrant. Privy Seal directed to the Treafurer and Barons there, whereby it was commanded to the Treafurer and Barons to accompt with them in this Behalf; (2) which Warrants oftentimes have been denied, becaufe that the King's Officers newly made percafe ' Zz 'had
