D. 1533. rr.cnf, Wax and filken Laces convenient for the fame, and fhall take for his Pains fuch Sums of Money as A Clerk affign- fhall be hereafter in this prefent Aft to him limited in that Behalf for the fame; (z) and that likewife your cd by the K'.rig Grace, your Heits and SuccefTors, fhall by your Letters Patents, under your Great Seal, ordain, depute matious C °" hi " and conftitute one fufficient Clerk, being learned in the Courfe of the Chancery, which {hall always be attendant upon the-Lorcl Chancellor, or the Lord Keeper of the Great Seal for the Time being, and fhall make, write' and enroll the Confirmations of all fuch Licences, Difpenfations, Inftruments or other Writing as fhall be thither brought under the Archbifhop's Seal, there to be confirmed and enrolled; and fhall alio intitle in his Books, and inroll of Record, fuch other Writings as fhall thither be brought under the Archbifhop's Seal, not to be confirmed, taking for his Pains fuch reafonable Sums of Money as here- after by this Act to him fhall be limited for the fame; (3) and that as well the faid Clerk appointed by the faid Archbifhop, as the faid Clerk to be appointed by your Highnefs, your Heirs or SuccefTors, fhall fub- fcribe their Names to every fuch Licence, Difpenfation, Faculty, or other Writing that fhall come to theit Hands to be written, made, granted, fealed, confirmed, regiftercd, and inrolled by Authority of this Aft, in Form as is before rehearfed. And forafmuch as the Charges of obtaining the faid Licences, Difpenfations, Faculties, and other qualified vftich c Refcripts or Writings aforenamed, at the Court of Rome, by the LolTes and Exchanges, and in conducting /hen""! obt»m- °' r Currors, and waging Solicitors to fue for any fuch Licences, Difpenfations, Faculties, Inftruments, ing Difpenfations ' and other Refcripts or Writings, have been grievous and exceffive to your People, and many Times and Licences ' greater Sums have been demanded for the fpeedy Expedition in- the Court of Rome, than be expreffed in from Rome. ' the old Tax limited to be paid for the faid Expeditions, whereby your People hath been brought to an ' Incertainty upon the Payment for Expeditions of fuch Things, and by reafon thereof have been con- ' {trained to pay more than they were wont to do, to the great impoverifhing of this Realm, as is afore- ' faid; (2) and fometimes the fpeeding of fuch Difpenfations, Faculties, Licences, and other Writings at ' Rome, hath been fo long deferred, that the Parties labouring for the fame have fuffered great Incommo- ' dities and Lofs for lack of quick Speed, which hereafter may be had within this your Realm, to the great ' Commodity of your People, whereby the Charges of making Exchanges, conducting of Currors and So-' ' licltors for the faid Difpenfations, fhall be abated, and your People' fo much relieved and eafed; to the ' Intent that all Ambiguity, and Incertainty of Payments for Difpenfations, Faculties, Licences, and other ' Refcripts and Writings, may be taken away, that no Fraud or Exaction fhall be exercifed upon your ' People, by fuch Officers as fhall be appointed by this Act, to take Pains in fpeeding fuch Difpenfations, ' Faculties and Licences, but that your People may be fure and certain what they be appointed to pay ' for the fame :' Two Books /hall XL Be it enacted by this prefent Parliament, and by the Authority of the fame, That there fhall be bt made wherein iwo Books drawn and made of one Tenor, in which fhall be contained the Taxes of all cuftomable Dif- Difpenfarions penfations, Faculties, Licences, and other Writings wont to be fped at Rome, which Books, and every shall be written. Leaf of thofe Books, and both Sides of every Leaf, fhall be fubferibed by the Archbifhop of Canterbury, the Lord Chancellor of England, the Lord Treafurer of England, and the two Chief Juftices of both Benches for the Time being; to the which Books all Suitors for Difpenfations, Faculties, Licences, and other Writings afore-rehearfed, fhall have Recourfe if they require it; (2) and one of the faid Books fhall re- main in the Hands of him which fhall be appointed to be Regifter and Scribe of the faid Difpenfations, Faculties and Licences, under the faid Archbifhop of Canterbury, in Form as is before faid; (3) and the other Book fhall remain with the Clerk of tha Chancery, which by your Grace, your Heirs or Succeffors fhall be appointed, as is before rehearfed; (4) which Clerk of the Chancery fhall, alfo intitle, and note particularly and daily, in his Book ordained for that Purpofe, the Number and Qualities of the Difpenfa- tions, Faculties, Licences and other Refcripts and Writings, which fhall be fealed only with the Seal of the faid Archbifhop, and alfo which fhall be fealed with the faid Seal, and confirmed with the Great Seal, in Form as is before faid, that all Fraud and Concealment in this Behalf may be avoided. The Fees of XII. And be it enacted by this prefent Parliament, and by the Authority of the fame, That no Man Diipeniations, fuing for Difpenfations, Faculties, Licences, or other Refcripts or Writings, which were wont to be fped •ences &c " at ■^- ome i fhall pay any more for their Difpenfations, Licences or Refcripts, than fhall be contained, taxed and limited in the faid Duplicate Books of Taxes, only Compofitions excepted, of which, being arbitrary, no Tax can be made, wherefore the Tax thereof fhall be fet and limited by the Difcretion of the faid Arch- bifhop of Canterbury, and the Lord Chancellor of England, or the Lord Keeper of the Great Seal for the The Penalty of Time being; (2) and that fuch as fhall exact or receive of any Suiter more for any Difpenfation, Faculty Kxtortion in Of- or Licence, than fhall be contained in the faid Books of Taxes, fhall forfeit ten Times fo much as he fhall I Seers. f extortioufly exact and receive; the one Half of the which Forfeiture to be to the Ufe of your Grace, your Heirs or SuccefTors, and the other Half thereof to be to fuch of your Subjects as will fue for the fame by Action, Bill or Plaint, in any of your Grace's Courts,, wherein the Defendant fhall have none Effbin nor Protection allowed, neither fhall be admitted to wage his Law.
