D. 1694, i traTisfer the Right and Property in and unto fuch Bill or Bills obligatory and of Credit, and the Monier ! .due upon the fame ; and that the Aflignee or Allignees fhall or may Tue for, and maintain an Action there- , upon in his own Name. XXX. Provided always, and it is hereby further cnafted. That if the Governor, Deputy Governor, the Diredtors, Managers, Affiftants, or other Members of the faid Corporation fo to be eftablifhed, fhall upon the Account of the faid Corporation, at any Time or Times purchafe any Lands or Revenues be- belonging to the Crown, or advance or lend to their Majefties, their Heirs or SuccelTors, any Sum or Sumfi of Money, by way of Loan or Anticipation, on any Part or Parts, Branch or Branches, Fund or Funds of the Revenues now granted or belonging, or hereafter to be granted or belonging to their Majefties, their Heirs or Succeffors, other than fuch t und or Funds, Part or Parts, Branch or Branches of the faid Re- ' venues only, on which a Credit of Loan is or fhall be granted by Parliament ^ that then the faid Governor, Deputy Governor, Direftors, Managers, or Affiftants, or other Members of the faid Corporation, who fhall confent, agree to, or approve of, the advancing or lending to their Majefties, their Heirs or SucceflVrs, fuch Sum or Sums of Money as aforefaid, and each and every of them fo agreeing, confenting, or ap- proving, and being thereof lawfully convidled, ihall for every fuch Offence forfeit treble the Value of every fuch Sum or Sums of Money fo lent, whereof one fifth Part fhall be to the Informer, to be recovered in any of their Majefties Courts of Record at IVeJlminJler, by Aftion of Debt, Bill, Plaint or Informatbn, wherein no Proteftion, Wager of Law, Eflbin, Privilege of Parliament, or other Privilege fhall be allowed, nor any more than one Imparlance; and the Refidue to be difpofed of towards publick Ufes, as (hall be direiSced by Parliament, and not -otherwife. XXXI. Provided always, and be it enafted. That all Amerciaments, Fines, and Ifliies, againft the faid Corporation, and their SucceiFors, had, charged, or eftreated, in or upon Account of any Suits or Aftions to be profecuted or brought againft them, fhall not be pardoned, acquitted, or difcharged by any Letters of Signet, Privy Seal, or Great Seal of their Majefties, their Heirs or Succeffors, or otherwife howfoever-; and m cafe any fuch Amerciaments, Fines, or Iffues, fhall be eftreated into their Majefties Exchequer againft the faid Corporation, upon any Procefs for IS on-appearance at the Suit of any Perfon or Perfons, that then it fhall and may be lawful to and for the Officers of their Majefties £'*'(r/'fy«^r for the Time being, v/ho are hereby dire£ted to pay the faid yearly Sum of one hundred thoufand Pounds to the faid Corpora- tion, to detain fo much Money as the faid Amerciaments, Fines, or Iffues fhall amount unto, out of the faid yearly Sum of one hundred thoufand Pounds payable to the faid Corporation. , ' XXXII. And be it further enacSted, That if at any Time hereafter any Perfon or Perfons fhall obtanf any Judgment or Judgments in any Court of Law againft the faid Corporation for any Debt or Sum of Money, and fhall bring Execution or Executions thereupon unto the faid Officers of their Majefties £*>- chequer, that then it fhall and may be lawful to and for the faid Officers of the faid Exchequer, to pay, and they are hereby required to pay, the faid Sum or Sums of Money, in the faid Executions mentioned, to the Plaintiff or Plaintiffs therein named, or their Affigns, whofe Receipt fhall be a fufficient Difcharge for the fame ; and that the faid Officers of the faid Exchequer fhall and may detain fo much of the faid yearly Sum of one hundred thoufand Pounds as the faid Debt or Debts fhall amount unto. ' XXXIII. And whereas by an KSt of this prefent Seffion of Parliament, intituled. An ASi fir ' granting to their Majejlies certain Rates and Duties tipon Salt, and upon Beer, Ale and other Liquors, ' for fecuring certain Recompences and Advajitages, in the Jaid A£l mentioned, to fuch Perfons as Jhall voluntarily ' advance the Sum of ten hundred thoufand Pounds towards carrying on the War againft France, it is enadiea, ' That no Member of the Houfe of Commons fhall at any Time be concerned in the farming, collefting, ' or managing any Sum or Sums of Money, Duties or other Aids by the faid Aft or any other A<3: of ' Parliament granted or to be granted to their Majefties, except the Perfons in the faid Aft excepted ; and ' whereas fome Doubts may arife, whether any Member or Members of Parliament may be concerned in ' the Corporation to be erefted in purfuance of this Aft ;' Be it therefore declared and enafted by the Au- thority aforefaid. That it fhall and may be lawful to and for any Member or Members of the Houfe of Commons, to be a Member or Members of the faid Corporation for the Purpofes in this Aft mentioned; any Thing in the faid recited Aft contained to the conrrary in any wife notwithftanding. XXXIv. And be it further enafted by the Authority aforefaid. That it fliall and may be lawful for any Perfons, Natives or Foreigners, to contribute towards the advancing of the Sum of three hundred thoufand Pounds, other Part of the faid Sum of fifteen hundred thoufand Pounds, by paying into the Receipt of their Majefties Exohequer, at any Time before the nine and twentieth Day of September one thoufand fix hundred ninety and four, any Sum or Sums of Money, not exceeding in the whole the Sum of three hundred thoufand Pounds, upon the Terms following (that is to fay) That every fuch Perlbn, his Exe- cutors, Adminiftrators or Aifigns, out of the Rates and Duties granted by this Aft, fhall have and receive for every Sum of one hundred Pounds, fo by them refpeftively advanced and paid, fuch yearly Annuity, Rent or Payment, as herein after is direfted (that is to fay) That if fuch Contributor fliall advance and pay his Money upon one Life only, then he fhall have and receive a yearly Annuity, Rent or Payment of fourteen Pounds of lawful Englijh Money, for every hundred Pounds, and fo proportionably for a greater .
