' Riding, for that the Clerk of the Peace thereof for the time being, who hath the keeping of the faid In- ' rolhnents within the faid Well Riding, is not by the faid Aft enjoined to give any Security for the fafe ' keeping, nor under sny Penalty for the negligent keeping of the faid Inrollments, nor is there by the ' faid A61 any certain Place appointed for keeping thereof: And whereas by an A&. of Parliament made ' in the fecond Year of her prefent Majefty's Reign, intituled, Jn Jifjbr the publick regiftrlng of all Deeds., ' Conveyances.^ and Wills, that Jlmll be made of any Honors, Manors, Lands, Tenements, or Hereditaments ' within the Wejl Riding of the Comity of York, after the nine and twentieth Day of September one thoufand ' jeven hundred and four ; a publick Oifice hath been crefted and eftabliflied at IVakefield within the faid ' Weft Riding, at the publick Charge thereof, for regiftring and fafe keeping of Memorials of all Deeds, ' Conveyances, and Wills v/ithin the faid Riding, and a publick Regifter hath been chofen, who hath, ' according to the Diredlion of the fame A(Sl, given fufficient Security for the due Execution of the faid ' Office :' For the rendring therefore the aforefaid Aft, made in the twenty-feventh Year of the Reign of King Henry the Eighth, more eiFeftual and beneficial to the Inhabitants of the faid Weft Riding, as to all Inrollments of Bargains and Sales within the faid Weft Riding ; may it pleafe your moft Excel- lent Majefty that it may be enafted, and be it enafted by the Queen's moft Excellent Msjefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Par- liament aflembled, and by the Authority of the fame, That from and after the four and twentieth Day of fune in the Year of our Lord one thoufand feven hundred and feven, all Bargains and Sales of any Manors, Lands, Tenements and Hereditaments, fituate, lying, and being within the faid Weft Riding, which fhall be inrolled before the faid Regifter, or his Deputy for the time being, in the faid publick Office at Wakefield, fhall be as good, effeftual, and available, to all Intents and Purpofes whatfoever, as if the fame had been inrolled in one of the Queen's Courts of Record at Weftminfier, or before the Cuflos Rotulortim, and two Juftices of the Peace, and the Clerk of the Peace of the faid Weft Riding, or two of them, according to the aforefaid Aft made in the twenty-feventh Year of the Reign of King Henry the Eighth ; and the faid Regifter, or his Deputy, for the time being (together with one or more Juftice or Juftices of the Peace of the faid Riding) fhall have Power to take and enter the Acknowledgement of the Bargainer, if but one, or of one of the Bargainers, if more, in fuch Bargains ai-id Sales; and fhall well and fufficiently inroll, by ingrofling in Parchment Rolls or Parchment Books, all fuch Bargains" and Sales as fhall for that Purpofe be acknov/ledged before him as aforefaid ; and fliall endorfe a Certificate on fuch Bargains and Sales, of the Times of inrolling thereof, andfign the fame; and the Rolls or Books thereof fhall fafely keep in the faid publick Office, there to remain upon Record amongft the Memorials of Deeds there regiftred. II. And be it further enafted, That all Deeds of Bargain and Sale fo inrolled in the faid Publick ot Regifter Office as aforefaid, which fhall appear to be fo inrolled by an Indorfement or Certificate on th^ faid Deeds of Bargain and Sale figned by the faid Regifter, or his Deputy, and that all Copies of the In- rollments thereof remaining on Record in the faid Regifter Office, fliall be allowed in all Courts wheri fuch Bargains and Sales, or Copies Ihall be produced, to be as good and fufficient Evidence as any Bar- gains and Sales inrolled in any of the Courts at Wefiminflsr, and the Copies of the Inrollments thereof.- ' III. And be it further enafted. That every fuch Inrollment of every fuch Deed in the faid Regifter Office as aforefaid, fhall be deemtd and adjudged to be the entering of a A/Iemorial thereof, purfuant to the faid Aft made in the fecond Year of her prefent Majefty's Reign, and fball have the fame Force and Effeft upon the Eftate therein mentioned, in relation to all fubfequent Deeds, Conveyances, and Wills, and to ail other Intents and Purpofes, as if a Memorial of fuch inrolled Deed had been entred in the faid Regifter Office, purfuant to the faid Aft. IV. And be it further enafted by the Authority aforefaid, That no Judgment, Statute, or Recogni- &c. toaftcftany .^.'i.TiCC (other than fuch as fliall be entred into in the Name, and upon the proper Account of her Majefty, ■Weft°Riding '" ^^ Heirs and SuccefTors) which fhall be obtained, or entred into, after the faid four and twentieth Day but from Time of fune in the faid Year of our Lord one thoufand feven hundred and feven, fhall affeft or bind any Ma- thac a Memodal nors, Lands, Tenements, or Hereditaments, fituate, lying, and being in the faid Weft Riding, but thereof be en- only from the Time that a Memorial of fuch Judgment, Statute, or Recognizance fhall be entred at the nffi '" ^^^*"'^ faid Regifter Office, expreffing and containing, in cafe of fuch Judgment, the Names of the Plaintiffs, and the Names and Additions therein of the Defendants, the Sums thereby recovered, and the Time of the figning thereof; and in cafe of Statutes and Recognizances, expreffing and containing the Date of fuch Statute or Recognizance, the Names and Additions of the Cognizors and Cognizees therein, and Manner of - for what Slims, and before whom the fame were acknowledged ; and that in order to the making ah Entry making Entry, gf fuch Memorials of Judgments, Statutes and Recognizances as aforefaid, the Party and Parties defiring the fame, fhall produce to, and leave v/ith the faid Regifter, or his Deputy, to be filed in the faid Publick or Regifter Office, a Memorial of fuch Judgment, Statute or Recognizance, figned by the proper Officer, who fhall fign fuch Judgment, or his Succefibr in the fame Office, or by the proper Officer in whofe Office fuch Statute or Recognizance fhall be inrolled, together with an Affidavit fworn before one of the Judges at Weflminfier, or a Mafter in Chancery, that fuch Memorial was duly figned by the Officer whofe Name i'hall appear to be thereunto fet 5 which Memorial fuch refpeftive Officer is hereby required to give fuch Plaintiff or Plaintiffs, Cognizee or Cognizees, or his, her, or their Executors or Admini- ftrators, or Attorney, or any of them, he, flie, or they paying for the fame the Sum of one Shilling, and no more, r h M **"r ^- ^^^ ^^ '"^ further enafted.
