And whereas many Diftillers, on Pretence of reftifying of Spirits, do mix Spirits with Wafh and ' other Liquors, and afterward diPdl the fame, whereby his Majefty's Duties on low Wines are avoided, ' and not duly anfwered and paid, as by the former Aits is directed and appointed ;' For Prevention whereof >A!1 Spirits be it enafted and declared by the Authority aforefaid, That all Spirits made or drawn by any Diftiller i"»<ie from Mir- from any Mixture of Spirits with any Kind of Walh or other Liquor, (except common Water) (hall be ^i^h^waft'"^ deemed and taken to be low Wines, and fhall be chargeable with the Duties already fet and impofed on deemed low low Wines drawn from foreign Materials. _ _ Wines, and • X. That in fuch Houfe and Houfes, and chargeable with other Edifices which were ufed as publick or open Diflilleries for the drawing or diftilling of Spirits or the Duties. low Wines from Wort or Drink brewed from malted Corn, during the Year ended on the thirtieth Day P"'^«  of September one thoufand fix hundred ninety and eight, or during any Part thereof (and in no other Houfe or Place whatfoever) it fhall and may be lawful to and for the Owners and Occupiers of the faid Houfes and Diftilleries refpedtively, at any Time or Times between the laft Day of January one thou- fand fix hundred ninety and eight, and the firft Day of February one thoufand fix himdred ninety and nine, to draw, diftif, and make, or caufe to be drawn, diftilled, and made, any Spirits or low Wines from Drink or Wort brewed from malted Corn, fo as the whole Qiiantity of low Wines or Spirits of the firfl Extraction, which between, the faid lafl: Day of January one thoufand fix hundred ninety and eight, and the faid firfl Day of i^^ZirKary one thoufand fix hundred ninety and nine, fhall be drawn, diftilled, or made in every fuch Diftillery refpeftively, from any Malt, Corn, or Grain, or from the Produce thereof, _ do not in the whole exceed half the Qjjantity of low Wines or Spirits of the firft Extraction, which in the Year already ended, as aforefaid, were drawn, diftilled, or made within the fame Houfe or Diftillery refpeftively, from Drink or Wort brewed with malted Corn, and fo as the Quantity of low Wines or Spirits of the firft Extraftion, which in the firft, fecond, third and every other Kalendary Month of the Year, reckoned from the faid laft T)z.y oi January one thoufand fix hundred n in ty and eight, fhall be drawn, diftilled, or made in every fuch Diftillery refpeclively, from Malt, Corn, or Grain, or from the Produce thereof, do not exceed half the Quantity of low Wmes or Spirits of the firft Extradlion, which in the like firft, fecond, third, and every other Kalendary Month of the Year, ended as aforefaid, were drawn, diftilled, or made within the fame Houfe or Diftillery refpeftively, from Drink or Wort brewed with malted Corn ; and in Cafe any Doubt or Controverfy fhall arife concerning the Qiiantity of Spirits or low Wines which were drawn or diftilled in any Houfe or Diftillery within or dui'ing the faid Year, ended on the faid thirtieth D y of September one thoufand fix hundred ninety and eight, or Sinj Month of the fame, from Drink or Worts brewed from malted Corn, or concerning the exceeding of half that Quantity or Proportion in the Year to be reckoned from the faid laft Day of January one thoufand fix hundred ninety and eight, or in any Month thereof, then the fame fhall be determined by the Accounts or Vouchers returned into the head Office of the Excife, containing the Quantities of fuch low Wines or Spirits of the firft Extraction made in every fuch Houfe or Diftillery within or during the Year already ended, as aforefaid, whereby his Majefty's Duties were charged or chargeable, or by the Entries of the fame, to which all Perfons concerned (upon reafonable Requeft) fhall have free Accefs without Fee or Charge ; any thing herein contained to the contrary notwithftanding. XL And be it enacted by the Authority aforefaid. That the Commiffioners of the Excife, or any three or more of them, upon Requeft to them made, fliall make forth and deliver in Writing under their Hands, gratis, to the Owners or Occupiers aforefaid, or fuch as they fhall appoint, a true Account of the C^antities of low Wines or Spirits of the firft Extradtion, charged in the faid Vouchers, as were made in every refpeftive Diftillery in each refpeCtive Month of the Year, ended at the thirtieth Day of September one thoufand fix hundred ninety and eight, as aforefaid, from Drink or Worts brewed with malted Corn. XIL And be it further ena£t?d by the Authority aforefaid, That no Perfon or Perfons whatfoever, from From 28 Feb- and after the laft Day of February in the Year of our Lord one thoufand fix hundred ninety and eight, 1698. to 1 Feb; and before the firft Day of February which fhall be in the Year of our Lord one thoufand fix hundred '*95- ^°'^^"* ninety and nine, fhall directly or indire£tly export, tranfport, carry out, convey, or caufe or procure to ' ^ ^ " be exported or tranfported, carried, or conveyed' out of or from the faid Kingdom of England, Dominion of Wales, and Town of Berwick upon Tweed, or any of them, or load or lay on board, or caufe or procure to be loaden or laid on board in any Ship, Veffel, or Boat, in order to be exported or carried out of the Kingdom, Dominion, or Town aforefaid, for any foreign Parts, any Beer Ale, or any Wafh or Worts drawn from Corn, or any Ale or Beer from which Spirits may be extracted, under the Pains and Forfei- tures herein after mentioned ; that is to fay, for every Barrel of Beer, Ale, Wafh, or V/orts ^o exported, Penalty. the Sum of five Pounds, and fo in Proportion for any greater or lelTer Qiiantity ; one Moiety thereof to his Majefty, and the other Moiety to the Informer, to be recovered as other Penalties by this Ad arc di- redted to be recovered.
