XVI. Provided always, and it is hereby enacted and declared, That no Appropriation or other Matter or Thing in this Act contained fhall obftruct or hinder any Payment or Payments which by and in purfu- ance of an Act made in the firft Year of his Majefty's Reign, intituled, An Ac! for enlarging the Capital Prov^f, Stock and yearly Fund of the South-Sea Company, and for fupplying thereby eight hundred twenty-two thoufand*""' 1 ' and thirty-two Pounds four Shillings and eight Pence to publick Ujesj and for raifing one hundred f;xty-nine'^ thoufand Pounds for the like Ufes, by Sale of Annuities, upon divers Encouragements therein mentioned ; and for appropriating feveral Supplies granted to his Majejly, are or fhall be required and authorized to be made by the Treafurer or Pay-mafter of the Navy for the Time being, or by any other Perfons to be intruded with the publick Monies for the Service of the Navy, out of fuch publick Monies, Tallies, Orders or Parlia- mentary Securities in their Hands or Power refpectively, as are or fhall thereby be charged or chargeable to make good any Deficiency or Deficiencies to be incurred on or before the twenty-fourth Day of june one thoufand feven hundred and eighteen to the Governor and Company of Merchants of Great Britain trading to the South-Seas and other Parts of America and for encouraging the Fifhery, or to their Treafurer for their Ufe ; any Thing herein contained to the contrary notwichftanding. XVII. XVIII. And as to the faid Sum not exceeding ninety-four thoufand Pounds by this A£t appropriated upon account of Half-pay as aforefai ', It is hereby enacted and declared by the Authority aforefaid, That the Rules herein after prefcribed fhall be duly obferved in the Application thereof; that is to fay, 1. That no Chaplain of any Garrifon or Regiment, who has any Ecclcfiaftical Benefice or other Prefer- ment in Great Britain or Ireland, fhall have or receive any Part of the faid Half-pay." 5. That no Perfon fhall have or receive any Part of the fame, who hath refigned his Coramiflion, and has had no Commiihon fince. 6. That no Part of the fame fhall be allowed to any Perfon by virtue of any Warrant or Appointment, ■except to fuch Perfons who would have been otherwiie entitled to the fame as reduced Officers. 7. And that no Part of the fame fhall be allowed to any of the Officers of the five Regiments of Dra- goons and eight Regiments of Foot lately difbanded in Ireland; except to fuch as were taken off the Efta- blifhment of Half-pay in Great Britain, Vol. V.
