And be it further enacted by the Authority aforefaid, That all and every the Annuities fo to'r: - An be purchafed upon this prefent Ait fhall be and are hereby charged upon, and fhall be paid and payable, r ° b ' ch . ar 8 cd . on from Time to Time, out of the Money arifing by the faid Rates and Duties, and other Prdvifiohs made by r b " '. n; ' virtue of this Aft for the Payment thereof; and that all and every Contributor and Contributors upon thi Aft, duly paying the Confideration or Purchafe-money at the Rate aforefaid, at or before the refpeftive Days or Times in this Aft limited in that Behalf, for any fuch Annuity or Annuities, as aforefaid, or fuch as he, file or they fhall appoint, his, her or their refpeftive Executors, Adminiftrators, Succefibrs and Afligns, fhali have, receive and enjoy, and be entitled by virtue of this Aft to have, receive and enjoy the refpeftive Annuity and Annuities, fo to be purchafed out of the Monies by this Aft appropriated, until the Redemption thereof by Parliament, according to the Provifo herein after contained in that Behalf, as is above-mentioned ; and that all and every fuch Purchafers, their Executors, Adminiftrators, Succefibrs, and Afligns refpeftively, fhall have good, fure, abfolute, and undefeazible Eftates and Interefh in the fc- veral Annuities fo by them refpeftively to be purchafed, according to the Tenor and true Meaning of this Aft; and that all fuch Eftates and Intereffs of" and in the faid Annuities, and every of them, fhall be, am; be i.djudged, taken and accepted in Conftruftion of Law, and in all Courts of Law and Equity whatfo- P" d °" a '^ tc > ever, to be a perfonal and not a real Efiate, and fhall go to the Executors or Adminiftrators of the Perfon Executors. or Perfons dying pofTefied thereof, interefted therein, or intitled thereunto, and not to the Heirs of fuch Perfon or Perfons ; any Law, Cuftotr., or Ufage to the contrary notwithstanding : And that all the faid Annuities to be purchafed on this Aft, as aforefaid, and every of them, fhall be free from all Taxes, lax ' ,ee- Charges and impofitions whatfoever. XXIX. And be it further enafted by the Authority aforefaid, That every Contributor upon this Aft for Contributors any fuch Annuity or Annuities, as aforefaid, his her or their Executors, Adminiftrators, Succefibrs, or doV-r Afligns, upon Payment of the Confideration or Purchafe-money for the fame, at the Rate aforefaid, or any ,-,, .^ ,- or t j, e ; r Part or Proportion thereof, into the faid Receipt of Exchequer, within the Time or Times in this Aft Annuities, Sec limited in that Behalf, iliall immediately have one or more Talley or Tallies levied, importing the Receipt of fo much Purchafe-money as fhall be fo paid, and upon Payment of all the Purchafe-money for any fuch Annuity or Annuities, at the Rate aforefaid, every fuch Contributor, his, her or their Executors, Adminiftrators, Succefibrs or Afligns refpeftively, fhall have an Order for paying the faid Annuity and An- nuities until the Redemption thereof by Parliament, according to the Provifo herein after contained in that Behalf; which Order fhall be figned by the Treafurer and Under Treafurer of the Exchequer, or any three or more of the Commiffioners of the Treafury for the Time being ; and after the Signing thereof the fame fhall be firm, goo!, valid and effeftual in the Law, according to the Purport and true Meaning thereof, and of this Aft, and fhall not be determinable by or upon the Deaths or Removal of any Trea- furer or Under Treafurer of the Exchequer, or any Commiflioner or Commiffioners of the Treafury, or by or upon the Determination of the Power, Office or Offices of them, or any of them, nor fhall any Lord High Treafurer of Great Britain, Treafurer of the Exchequer, or any Commiffioners of the Trea- fury now or for the Time being, have Power to revoke, countermand, or make void fuch Orders fo figned, as aforefaid, or any of them.. XXX. And tor the Encouragement of the Contributors to advance and pay readily into the Receipt of? '■ per Cent. Exchequer the Sums by them intended to be advanced upon this Aft : It is provided and enafted by the tcr W ™?* Authority aforefaid, That every fuch Contributor, who fhall advance and pay into the faid Receipt of p - , >' mcnt ' Exchequer, within the Times limited by this Aft, the Purchafe-money payable for any fuch Annuity or Annuities, as aforefaid, his, her or their Executors, Adminiftrators, Succefibrs or Afligns, fhall be allow- ed and paid out of the Contribution-money arifing by this Aft, Intereft after the Rate of five Pounds per Centum per Annum, for the prompt Payment of the Purchafe-money, or of fuch Proportions of the Pur- chafe-money, as fhall be fo advanced before the firft Day of December one thoufand feven hundred and twenty ; the faid Intereft to be computed for the refpeftive Sums fo advanced and paid into the Exchequer, from the Time or refpeftive Tinr es of the actual advancing and paying the fame into the Exchequer, until the (aid firft Day of December one thoufand feven hundred and twenty. XXXI. And be it further enafted, 1 hat it fhall and may be lawful to and for any Purchafer or Pur- Pwchafers may chafers of any fuch Annuity or Annuities, as aforefaid, his, her or their Executors, Adminiftrators, Site- th^inteteft'in ceflbrs or Aifigns, at any Time or Times during the Continuance of his, her or their Eftate or Intereft t i, e Annuities, of and in the fame, by any Writing under his, her or their Hands and Seals, or under the common Seal &c. of a Corporation, or by his, her or their Laft Will in Writing, to affign or devife his, her or their EftateBy qG.-o. i. or Intereft of and in any fuch Annuity or any Part thereof, to any Perfon or Perfons whatfoever, and fo c - ' 2- ioties quoties; and no fuch Affignment to be revocable, fo as an Entry or Memorandum of fuch Affignment m ^b^made or Will be made in Books to be kept for that Purpofe in the faid Office of the Auditor of the Receipt, by rndorfement within the Space of three Months after fuch Affignment or Death of the Devifor : And that upon producing on the Order, fuch Affignment or Will, or Probate thereof, in the faid Office of Receipt, to be entred, as aforefaid, the Party fo producing the fame fhall bring therewith an Affidavit taken before one or more of his Majefty's Juftices of the Peace, of the due Execution of the faid Affignment or Will, which Affidavits fhall be feve- rally filed in the faid Office, which faid Entry or Memorandum the proper Officers in the faid.
