The Money . V> And be it further enacted by the Authority aforefaid,. That the feveral and refpective Cotnmif- arifmgby thefe, fionersof 'Exeife fhall pay all the Monies that they reflectively (hall receive of the faid Duties (the ne- paiddUincI ceffary Charges of receiving, levying, managing and accounting for the fame excepted) into the Receipt From others, of bis Majefty's Exchequer, diftinct and apart from all other Branches of the publick Revenues, for the • Purpofes in this Act expreffed. and appiopri- VI. And it is hereby further enacted by the Authority aforefaid, That the Monies arifing by the faid ated to the Duties by this Act charged and impofed, fhall be appropriated, iffued and applied, and the fame are Ju m p U / es? s . hereby appropria ed and made payable to the fame Ufes, Intents and Purpofes as the faid lad mentioned fey determined." And for the Encouragement of the Exportation of Spirits drawn from Corn in Great Britain^ Spirits drawn be it further enacted by the Authority aforefaid, That from and after the faid twenty-fourth Day of from Britifh June one thoufand feven hundred and thirty-three, it (hall and may be lawful to and for any Diftiller Com, without or Diftillers, or other Perfon or Perfons, to export fuch Spirits drawn from Corn as aforefaid, upon Materials, * Oath made before any two or more of the Commifiioners of Excife, or Juftices of the Peace for the County or Place from whence any fuch Spirits, drawn from Corn in Great Britain, are intended to be en Oath and exported, That the fame are drawn from Corn in Great Britain without any Mixture with any other Certificate, &c. Materials, either native or foreign, and that the Duties of the fame are duly entered and paid, and that •the fame are exported for Merchandize to be (pent beyond the Seas; and upon producing a Certificate under the Hands of the Officers of Excife for the Port or Place where fuch Spirits were (hipped, of the Quantity fo (hipped, and that the fame was (hipped in the Prefence of fuch Officer, that fuch Diftil- ailowed aDraw- ler or Diftillers, or other Perfon or Perfons, fo exporting the fame, fhall be allowed or paid back by iS^perTun. the Commifiioners of Excife, or their Collector for the Port or Place where fuch Spirits fhall be fhipped off, the Sum of four Pounds eighteen Shillings for every Tun of fuch Spirits fo fhipped off, and fo in Proportion for any greater or leffer Quantity, in full of all Drawbacks and Bounty that can be made for the fame, except the Bounty of one Pound ten Shillings for every Tun of fuch Spirits, which fhall be payable at the Cuftom Home in Manner herein after directed. j W; & M. •' much of the faid Barley is made into Malt;' For preventing any Queftion or Difpute that may arife When Barley is thereupon, Be it enacted by the Authority aforefaid, That for every Tun of Spirits drawn from Barley,. Quarter per Malt or other Corn, there fhall be paid to the Exporter of the fame, by the Commifiioners of his Ma- jefty's Cuftoms, or other proper Officers belonging to them, when Barley is at twenty-four Shillings^ il. ios. allowed per Quarter or under, upon fuch Proof of the Exportation of the fame, as by the faid Act is directed, as a Drawback and out of fuch Duties as are liable to the Payment of the Bounties on Corn exported, the Sum of MaiTspirits" ° f one Pound ten Shillings, in the fame Manner as if the like Quantity of Barley, Malt or other Corn. exported. had been exported, and fo in Proportion for a greater or leffer Quantity. And for the more effectual fecuring the due Execution by the inferior Officers of his Majefty's tions. Cuftoms of the Provifions in the feveral Acts for preventing the running of Brandies; Be it enacted by the Authority aforefaid, That when any Officer or Officers of the Cuftoms fhall neglect to feize and; profecute any Veffel, Boat, Horfes or other Cattle or Carriage which fhall be forfeited for the Caufes- 50I. Penalty on above mentioned, every fuch Officer and Officers being thereof lawfully convicted upon his or their Off^rf h ° Ufe Appearance or Default, upon the Oath or Oaths of one or more credible Witnefs or Witneffes, or by Negieaofhis" 7 the Confeffion of the Officer or Officers, by or before one or more Juftice or Juftices of the Peace of Duty herein. the County, Divifion or Liberty where fuch Offence fhall be committed, or the Offender (hall be found (which Oath fuch Juftice or Juftices of the Peace are hereby required to adminifter) the Officer and Officers fo convicted fhall feverally forfeit for every fuch Neglect the Sum of fifty Pounds, one Moiety thereof to the Ufe of the King, and the other Moiety thereof to the Ufe of the Informer or Profecutor; the fame to be levied by Diftrefsuand Sale of the Offender's Goods, by Warrant under the Hand and Seal or Hands and Seals of fuch Juftice or Juftices of the Peace before whom fuch Offender fhall be convicted as aforefaid; and for want of fuch Diftrefs, every fuch Offender fhall by fuch Juftice or Juftices be committed to Prifon, there to remain without Bail or Mainprize for the Space of fix Months. icl.
