An Aft to prevent the infamous Practice of Stock-jobbing. s TITHEREAS great Inconveniencies have arifen and do daily arife by the wicked, pernicious-

'been and are diverted from purfuing and exercifing their lawful Trades and Vocations, to the ut- ' ter Ruin of themfelves and i amilies, to the great Difcouragement of Induftry, and to the manifeft ' Detriment of Trade and Commerce; ' For Remedy thereof, may it pleafe your moft Excellent Ma- jefty that it may be enacted, and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament afTembled, and by the Authority of the fame, That all Contracts and Agreements whatfoever, which fhall, from and after the firft Day of 'June one thoufand feven hundred and thirty- four, be made or entred into, by or between any Perfon or Perfons whatfoever, upon which any Premium or Confidera- tion in the Nature of a Premium fhall be given or paid for Liberty to put upon, or to deliver, receive, accept, or'refufe any Publick or Joint Stock, or other Publick Securities whatfoever, or any Part, Share, or Intereft therein, and alfo all. Wagers and Contracts in the Nature of Wagers, and all Contracts in the Nature of Putts and Refufals, relating to the then prefent or future Price or Value of any fuch Stock or Securities, as aforefaid, fhall be null and void to all Intents and Purpofes whatfoever, and all Pre- miums, Sum or Sums of Money whatfoever, which fhall be given, received, paid, or delivered, upon all fuch Contracts or Agreements, or upon any fuch Wagers, or Contracts in the Nature of Wagers, as aforefaid, fhall be rertored and repaid to the Perfon or Perfons who fhall give, pay, or deliver the fame, who fhall be at Liberty, within Six Months from and after the making fuch Contract or Agree- ment, or laying any fuch Wager, to fue for and recover the fame from the Perfon or Perfbns to whom the fame is or (hall be paid or delivered, with Double Cofts of Suit, by Action of Debt founded on this Act, to be profecuted in any of His Majefty's Courts of Record, in which Action no Eflbin, Protection,. • Wager of Law, or more than one Imparlance fhall be allowed; and it fhall be fufficient therein for the Plaintiff to alledge that the Defendant is indebted to the Plaintiff, or has received to the Plain- tiff's Ufe, the Money or Premium fo paid or received, whereby the Plaintiff's Action accrued to him, according to the Form of this Statute, without fetting forth the fpecial Matter. II. And for the better Difcovery of the Monies or Premium which mall be given, paid, or de- livered, and to be fued for and recovered, as aforefaid; it is hereby further enacted by the Authority aforefaid, That all and every the Perfon or Perfons who, by virtue of this prefent Act, fhall or may be liable to be fued for the fame, fhall be obliged and compellable to anfwer upon Oath fuch Bill as fhall be preferred againrt him or them in any Court of Equity for difcovering any fuch Contract or Wager, and the Sum of Money or Premium fo given, paid, or delivered, as afore^ faid. III. Provided always, That the Plaintiffs, Relators, or Informers in fuch Bill fhall and do (at the Time of bringing or filing fuch Bill) give good and fufficient Security to anfwer and pay. the Defendants in fuch Bill full Cofts of Suit, in cafe fuch Cofts lhail be adjudged to the Defend- ants, and that no Perfon lhall be obliged to appear or to anfwer fuch Bill, until fuch Security :s given. IV And be it further enacted by the Authority aforefaid, That all and every Perfon or Perfons what- foever, who fhall enter into, make, or execute any fuch Contract, Bargain, or Agreement, upon which any Premium, or Confederation in the Nature of a Premium, (hall be given or paid for Liberty to puit upoi or to deliver, receive, accept, or refufe anyPubiick or Joint Stock, or other Publick Securities whatfoever, or any Part, Share, or Intereft therein, or any Contract or Bargain in the Nature of Putts and Refufals, as aforefaid, or fhall lay any fuch Wager, or make any fuch Contract .in the Na- ture of a Wager, as aforefaid (except fuch Perfon or Perfons who fhall actually and bona fide, without Covin or Collufion, fue, and with Effect profecute for the Recovery of the Money or Premium given, delivered, or paid by him, her, or them, as aforefaid; and alfo except fuch Perfon or Perfons, who v fhall All Contracts made after I June 1734, for Liberty to put upon, ac- cept, or refufe any Publick Stocks or Secu- rities, and Wagers relating to the Value of Stocks, fhall be void, and the Money paid thereon, reftojed, or may be reco- ■ vered by Adtion commenced in 6 Months, with Double Cofls.. Perfons fued on this Ac> obliged to anfwer on Oath with Re- gard to fuch Contract. Plaintiffs, on riling a Bill, to give Security for anfwering Colts; ether- wife the De- fendant may re fufe to appear, jool. Penalty on making or executing any fuch Putts or Bargains. Exceptions.
