A. D. 1738. Anno undecimo Georgii II. C. 29,. 30. 317 Cloth or Cloths made in the Weft Riding of the County of York, and fo milled in the faid Counties of Directions for Lancajler, Cbejler or Derby, mall, before they are dried and tentered, be brought to the neareft Mill- SJ°w Tk-J" Man and Cloth Searcher in the faid Weft Riding of the faid County of York to be by this Act appointed, ofVork, and 2 and be by them meafured, at.d have their Lengths and Breadths damped and affixed thereto, and (hall milled in adja- be in every other refpect conformable to the fame Regulations and Payments as fuch Cloths are, which ctnt < -' oum ' es - are both made and milled in the faid Weji Riding ; and in Default thereof the Makers or Venders of fuch Cloths as aforefaid (hall be liable to the fame Penalties and Forfeitures as thofe are, who both make and mill Cloths in the faid Weft Riding of the County of York. Xv Provided always, and be it further enacted by the Authority aforefaid, That if any Action or Anions to be Suit after the Commencement of this Act (hall be brought, commenced, fued or profecuted againft any 'JJ' d '" Com ' Perfon or Perfons, by this Act authorized to put the fame or any Part thereof in Execution, in every or ' fuch Cafe the Action ihall be laid in the faid County of York, and not elfewhere ; and every fuch Perfcn or Perfons fo fued or profecuted may to fuch Action or Suit plead the General Iffue, and give this Act General Iffue, and the fpecial Matter in Evidence at any Trial to be had thereupon, and that the fame was done in purfuance and by the Authority of this Act ; and if it (hall appear fo to be done, or that fuch Action or Actions (hall be brought in any other County, that then the Jury (hall find for the Defendant or De- fendants ; and that upon fuch Verdict, or if the Plaintiff or Plaintiffs (hall be nonfuited, or difcontinue his Action after the Defendant or Defendants (hall have appeared, or if upon Demurrer Judgment (hall be given againft the Plaintiff or Plaintiffs, the Defendant or Defendants (hall and may recover Treble Treble Cofts. Colts, for which he and they (hall have the like Remedy, as in Cafes wherein Cofts are by Law given to Defendants : And that this Act (hall be taken and allowed as a Publick Act, in all Courts within this Pubiick A3.
