A. D. 1739. Anno duodecimo Georgii II. C. 19. 337 and afterwards it (hall not be in the Power of fuch Perfon or Perfons who have or hath made Inch Allignment to make void, releafa or difcharge the fame, or any the Monies thereby due, or any Part thereof. VII. And to the end there may be no Want or Failure of a certain Sum not to exceed in the whole the laid Sum of live hundred thoufand Pounds to be raifed either by fuch Loans as aforefaid, or by i (Thing Exchequer Bills as- is herein after mentioned, or by both or either of thofe Ways or Means, for the publick Service ; Be it further enacted by the Authority aforefaid, That in cafe the Commit- Treafury may iioners of his Majefty's Treafury, or any three or more of them now being, or the High Treafurer, raiCe >' or any three or more of the (Jommiifioners of the Treafury for the time being (hall judge it more advili-able outnevr Ex-he-' to raife the faid Sum of rive hundred thoufand Pounds, or any Part thereof, by Exchequer Bills inftead querBUls of fuch Loans as aforefaid ; that then they reflectively are hereby authorized and impowered at any Time or Times to prepare and make, or caufe to be prepared and made, at the Exchequer any Num- ber of new Exchequer Bills, for any Sum or Sums of Money, not exceeding in the whole the faid Sum of five hundred thoufand Pounds, together with fuch Loans as aforefaid, in the fame or like Manner, Form and Order, and according to the fame or like Rules and Directions as in and by a certain Act of Parliament for continuing the Duties on Malt, Mum, Cyder and Perry, for the Service of the Year one thoufand feven hundred and thirty-nine, are enacted and prefcribed concerning the Exchequer Bills to be made in purfuance of the fame Act. VIII. And be it further enacted by the Authority aforefaid, That all and every the Claufes, Pro- Chores of t'.u vifoes, Powers, Privileges, Advantages, Penalties, Forfeitures and Difabilities contained in the faid Malt . Aa 'Eg laft-mentioned Act, relating to the Loans or Exchequer Bills authorized to be made by the fame Act cheque! Bin,* (except fuch Claufes as do charge the fame on the Duties or Impofitions granted or continued by the to extend fo ' fame Act) (hall be applied and extended to the Exchequer Bills to be made in purfuance of this Aci, thofeofthis as fully and effectually to all Intents and Purpofes as if the fame Exchequer Bills had been originally * ' authorized by the faid laft-mentioned Act, or as if the faid feveral Claufes or Provifoes had been par- ticularly repeated or re-enacted in the Body of this prefent Act. IX. And be it enacted by the Authority aforefaid, That all the Exchequer Bills as (hall be made in The faid Bills purfuance of this Act, and the Intereft, Premium, Rate and Charges incident to, or attending the C i ha ^l ec l " fame, (hall be and are hereby charged and chargeable upon, and (hall be repaid and borne by or out of fund. the growing Produce of the faid Surpluffes, Exceffes and Overplus Monies, commonly called The Sink- ing Fund (except fuch Monies of the faid Sinking Fund as are appropriated to any particular Ufe or Ufes by any former or other Act or Acts of Parliament in that Behalf) and fuch' Monies of the faid Sinking Fund fhal! and may be iffued and applied, as faft as the fame can be regularly ftated and afcer- tained, for or towards paying off, cancelling and discharging fuch Exchequer Bills, Intereft, Premium, Rate or Charges, until the whole of them (hall be paid off, cancelled and difcharged, or Money fuffi- cient for that Purpofe be kept and referved in the Exchequer, to be payable on Demand to the re- fpective Proprietors thereof. X. Provided always, and be it enacted by the Authority aforefaid, That all the Monies coming Application of into the Exchequer, either by Loans or Exchequer Bills, upon one Act of this Seffion of Parliament, the Supplies, intituled, An Acl for continuing the Duties upon Malt, Mum, Cyder and Perry, in that Part of Great Bri- tain called England, and for granting to his Majcfly certain Duties upon A-lalt, Muni, Cyder and Pefry, in that Part of Great Britain called Scotland, for the Service of the Tear one thoufand feven hundred and thirty- nine, and fo much Money (if any fuch be) of the Duties thereby granted and continued, as (hall arife or remain after all the Loans or Exchequer Bills made or to be made on the fame Act, and all the Intereft, Premium, or Rate and Charges thereon, and the Charges thereby allowable for raifing the faid Duties (hall be fatisfied, or Money fufficient (hall be referved in the Exchequer to difcharge the fame; and all the Monies coming into the Exchequer, either by Loans or Exchequer Bills, upon one other Act of this Selhon of Parliament, intituled, An A5i for granting an Aid to his Majejly by a Land Tax, to be raifed in Great Britain, for the Service of the Year one thoufand feven hundred and thirty-nine, and fo much Money (if any fuch be) of the Tax thereby granted, as (hall arife or remain, after all the Loans or Exchequer Bills made or to be made on the fame Act, and all the Intereft, Premium, or Rate and Charges thereon, ant! the Charges thereby allowable for raifing the faid Land Tax, (hall be fatisfied, or Money fufficient (hall be referved in the Exchequer to difcharge the fame; and alfo the Sum of one hundred nine- teen thoufand four hundred fifty-one Pounds Seventeen Shillings and nine Pence, granted for the Service of the Year one thoufand iz^tw hundred and thirty-eight, and not appropriated for the Service of that Year ; and the Sum of one million by this Act granted as aforefaid, lhall be further appropriated and applied, and are hereby appropriated for and towards the feveral Ufes, Intents and Purpofes herein after expreffed, fubject neverthelefs to fuch Restrictions as are herein after prefcribed ; that is to fay, It is hereby enacted and declared, That out of all or any the Aids or Supplies aforefaid, there fhall 8+6,689 1. i*. and may be iffued and applied any Sum or Sums of Money, not exceeding eight hundred forty-fix |^%ic^ ■ thoufand fix hundred eighty-nine Pounds two Shillings and fix Pence, for or towards the naval Ser- vices herein after more particularly ■expreffed ; that is to fay, For or towards defraying the Charge ot the Ordinary of his Majefty's Navy, and for H.ilf pay to Sea Officers, and for or towards Vic- tuals, Wages, Wear and Tear of the Navy, and the Victualling thereof, performed and to be per- formed ; and for and towards Sea Services in the Office of Ordnance, performed and to be performed. XI.
