422 C. Z5> Anno decimo quarto Georgii II. A. D. 1741, ' Commonable Fens and Warte Grounds, that the fame be done by a common Day-work ; and then upon publick Notice to be by them given for that Purpofe, by fending a Bell about the Town, every Owner or Occupier of a Common there, fhall come in at the Time appointed and do the fame, or fend a fufficient able-bodied Man for every Houfe or Common, with proper working Tools, and in De- fault and Neglect thereof, to forfeit and pay to the faid Fenreeves eighteen Pence per Day, for every Day, for every Houfe or Common, not performed as aforefaid, to be employed and beftowed in amend- ing and repairing the Banks, or fcouring the Drains as aforefaid ; and that for defraying fuch like and other neceflary and incident Charges of Gates, Bars, Bridges and other Things, it (hall and maybe lawful for the faid Fenreeves, or any one of them for the time being, by and with the Confent of the major Part of the Commoners, Inhabitants of Waterbeach aforefaid, who (hall, upon Notice to be given to meet in the Parifh Church of JVaterbeacb aforefaid, for that Purpofe be afTembled, to make a Rate or Rates upon the Occupiers of the feveral Commonable MefTuages or Tenements at Waterbeach aforefaid, which Rate or Rates ihall from that time be allowed and confirmed by one or more Juftiee or Juflices of the Peace for the faid County, and to be then levied on fuch as (hall neglect or refute the Payment thereof, by Diftrefs and Sale as aforefaid, and fo from time to time as Occalion fhall require. Provided, That if any think himfelf or themfelves aggrieved by fuch Rate or Rates, Appeal may be made at the next General Quarter-Seffions of the Peace to be held for the faid County where the fame fhall be heard and finally determined ; and that the faid Fenreeves, or fuch of them as (hall receive any Money, either by Rate or otherwife, belonging to the faid Office, (hall within one Week after the Year for which he (hall be fo chofen and ferve, make a true, full and perfect Account of all his Receipts and Difburfements in the faid Office, and pay the Balance thereof (if any (hall remain) to the next fucceeding Fenreeves, fome or one of them ; upon Pain of forfeiting to the Lord of the faid Manor for the time being, five Pounds for every Month fuch Account fhall remain unfettled, or the Balance thereof (if any) unpaid, to be levied and recovered by Diftrefs and Sale as aforefaid ; in which Account it (hall be lawful for the faid Fenreeves to retain in their refpective Hands the Sum of twenty Shillings for their Care and Pains in the PremifTes. 1 VIII. That the Owner or Occupier of the Rectory of Waterbeach for the time being may keep four- fcore Sheep in the Town Flock, which fourfcore, as well as thofe herein before limited and appointed to be kept by the Commoners, are only to go, departure and feed in fuch Places, and at fuch Times only, as the Sheep have heretofore ufually done in Waterbeach aforefaid ; and that the Flock kept or to be kept by the faid Peter Standlcy, or his Tenant or Tenants of the Farm now in the PoffefJion of John Hemington, fhall not exceed four hundred in Number, and fhall not go or departure in Hill-field farther than Milhvay in Waterbeach aforefaid ; and that the Denny Abbey Flock (hall not exceed eight hundred in Number, and (hall not go in Home Earmold or Wingfold, or any of the Town Fields ; and that there may be kept in the Town Flock two Sheep for every five Acres of Arable Land in Watcrbea h aforefaid, by the Owner or Occupier thereof ; and that Lambs be deemed Sheep upon the eleventh Day of Ns~ ve ber yearly. ' IX. That for the better diftinguifhing every one's Cattle, the Owner or Owners thereof (hall yearly, before they be put upon the Common, brand them with a pitched Brand, with the firft Letter of Chri- ftian and Surname, and deliver a Copy of fuch Brand to the Fenreeves, or one of them, on or before the firft Day of March yearly ; on Pain of forfeiting to the Lord of the faid Manor for the time being, for every Beaft not branded as aforefaid, and for every Time they (hall be found there not branded as aforefaid, twelve Pence per Head, and for neglect or refufing to deliver a Copy of the Brand as aforefaid,' five Shillings per Week, fo long as the fame (hall remain undelivered, to be levied and recovered by Diftrefs and Sale aforefaid. 'X. That for clearing and taking away all future Doubts, iris hereby declared and agreed, That the chief Capital Manfion-houfe of the faid Peter Standley, in Waterbeach aforefaid, called Denny Abbey, is. and (hall from henceforth always be deemed to be a Commonable Houfe in Waterbeach aforefaid. ' XI. That an Act of Parliament, if it can or may be obtained, for the better eftablifhing and better enforcing the due Execution of thefe Prefents in fuch Manner as Counfel (hall advife, fo as nor to en- large the Number or Stint of Cattle herein before limited.
