Direflions for III. And be it further enacted by the Authority aforefaid, That if the Certificate of the Regifter of any irgiflring a ship Ship or VefTel fhall be loft, and the Mafter or Perfon having Charge of the faid Ship or V-cilel, and one de "£"?• ^ or more of the Owner;, fhall make Proof to the Satisfaction of the Commiffioners of his Majefty's Cu- ti'it Certificate 8 ^ orns > I 11 ca ' e the Owner or Owners or any of them fhall refide in Great Britain or Ireland, Gucrnfey or ■ ' ' Jerfey, or of the Governor or Collector of the Cuftoms, rending in any of his Majefty's Plantations in A- merica, in cafe fhe was regiftred in fuch Plantation, and none of the Owners fhall refide in Great Britain or Ireland, Guernfey or "Jerfey, upon Oath, or in cafe of a Quaker, upon folemn Affirmation of the Lois ojf fuch Certificate, and likewife of the Name, Burthen, built, Property and other Particulars required by the faid Ad of the feventh and eighth of King William the Third, in the fame Manner, and before the fame Perfons, as by that Act are required upon original Regifters; and fhall likewife give good and fufficient Security, in the Penalty of five hundred Pounds, if the Ship or Veffel be of the Burthen of one hundred Tons, and fo in Proportion for every Ship or VefTel of a greater Burthen, to the Collector of the Port, to which fuch Ship or VefTel fhall belong; and that the original Certificate hath not been, nor ihall be fraudulently difpofed of, or ufed contrary to Law; and that the fame when found, fhall be deli- vered up to the Commiffioners of the Cuftoms to be cancelled; in fuch Cafe, it fhall and may be lawful for the faid Commiffioners of his Majefty's Cuftoms, and the Governor and Collector of the Cuftoms, re- ading at the Plantations refpe&ively; and the faid Commiffioners, Governor and Collector are hereby required to permit the faid Ship or VefTel to be regiftre i de novo; and the proper Officers (hall deliver a Certificate thereof to the Owner or Owners regiftring the fame, in the Manner directed by the faid, Aft of the feventh and eighth of King William the Third, and therein mention the Name by which the Ship or VefTel was formerly regiftred, and that fuch Certificate of a new Regifter is granted in purfuance of this Aft, inftead of a former Certificate, which appears by fuch Proof as this Aft requires, to be loft; and that fuch new Regifter and Certificate fhall have the fame Force and Effeft as if the fame were an original Regifter and Certificate, and no other; and a Duplicate thereof fhall be tranfmitted by the Offi- cers who (hall grant the fame to the Commiffioners of his Majefty's Cuftoms. ' IV. And whereas by the before recited Aft of Parliament made in the feventh and eighth Years of ' the Reign of King William the Third, for preventing Frauds, and regulating Abufes in the Planta- ' tion Trade, it is enacted among other Things, That in all Bonds (commonly called Plantation Bonds) that are given in the Plantations, in purfuance of an Aft of Parliament made in the twelfth Year of the Reign of King Charles the Second, for encouraging and encreafing of Shipping and Navigation, and »a Car. i.e. 26. ' another Act made in the twenty-fecond Year of his faid Majefty's Reign, to prevent planting Tobacco ' in England, and regulating the Plantation Trade, the Governors of the Plantations, before they permit
- any Ship, that by Law is to trade there, to load on board any of the Commodities enumerated in the
' faid Act laft mentioned, are to take Bond in the Manner, and to the Value expreffed and directed by the ' faid Aft, that fuch Ships or Veffels (hall carry all the aforefaid enumerated Goods that fhall be laden on
- board the faid Ship, to fome other of his Majefty's Britijh Plantations, or to Great Britain; and that
' the Condition of the faid Bonds fhall be within eighteen Months after the Date thereof ( the Danger of ' the Seas excepted) to produce Certificates of having landed and difcharged the Goods therein menti- ' oned, in one of his Majefty's faid Britijh Plantations, or in Great Britain, otherwife fuch Bonds to be ' in full Force : But there being no Proviiion made in any of the faid Acts, or any other Law, for return- ' ing and producing Certificates within any limited Time of the landing and difcharging fuch Goods for ' fuch Ships as give Bond in Great Britain, in purfuance of the Directions of the faid Afts made in the ' twelfth and twenty-fecond Years of King Charles the Second;' Be it therefore enafted by the Au- TW Condition thoriry aforefaid, That from and after the twenty-ninth Day of September one thoufand feven hundred and ef-Planucion - forty-; two, That in all Bonds, commonly called Plantation Bonds, which (hall be hereafter taken or en- Scnd trc-d into in Great Britain, in purfuance of the faid Aft, or any other Law fince made, whereby the Goods therein enumerated are to be brought to Great Britain, fuch Bonds fhall be with Condition, that within eighteen Months from the Date thereof (the Danger of the Seas excepted) a Certificate fhall be produced from the Collector and Comptroller of the Port where fuch Goods lhall be delivered, that they have been there ianded and difcharged, otherwife fuch Bonds fhall be forfeited, and the Penalty thereof fhall and may be fued for in his Majefty's Court of Exchequer in England, Scotland or Ireland reCpcctivzly; provided that this Act fhall not extend or be conitrued to extend to Bonds given for Ships which lade Rice at Carolina or Georgia, by Virtue of a Licence granted by the Commiffioners of the Cuftoms, to be carried to fome j Ceo..:, e. 2?.
