D. 1743. ing down for the fame the aforefaid Sum of twenty Shillings at the Time of taking out thereof; but if fuch Licence fhall be taken out without the Limits aforefaid, then fuch Licence (hall be granted under the Hands and Seals of the feveral Collectors and Supervifors of Excife, within their respective Collec- tions and Diftricts, and the Duty for the fame fhall be paid by all and every the Perfons fo taking out fuch Licence, at the Office of Excife next adjoining to the Place where he, fhe or they refpectively refide or inhabit, or at any other Place, and to fuch Pcrlons as his Majefty's Commiffioners of Excife for the Time being (hall appoint to receive the fame; and fuch Perfons as by the faid Commiffioners fhall be ap- pointed, are hereby impowered to deliver fuch Licences to any fuch Perfon or Perfons, upon his, her or their paying down for the fame the aforefaid Sum of twenty Shillings at the Time of taking out thereof: Management of And in cafe fuch Licences be taken out within the Limits of the City of Edinburgh, fuch Licences fhall Licences in, De granted under the Hands and Seals of two or more of his Majefty's Commiffioners of Excife in Scot- cotan , j an 2 f or t ^ & Yime being, and the Duties for the fame fhall be paid at the chief Office of Excife in Edin- burgh, in the fame Manner as is herein before directed, in regard to the Licences to be taken out within the Limits of the Weekly Bills of Mortality ; but if fuch Licences fhall be taken out in any other Part of Scotland, without the Limits aforefaid, then fuch Licences fhall be granted under the Hands and Seals of the feveral Collectors and Supervifors of Excife in Scotland, within their refpective Collections and Diftricts, and the Duties for the fame fhall be paid in like Manner as is herein before directed with regard to the Licences to he taken out in England, without the Limits of the Weekly Bills of Mortality. Fiefh Licences IX. And be it further enacted by the Authority aforefaid, That every Perfon or Perfons who fhall every Year. take out fuch Licence as aforefaid, is and are hereby required to take out a frefh Licence ten Days at the lead before the Expiration of twelve Months, after the taking out the firft Licence, before he, fhe or they do prefume to offer to retale any fuch Spirituous Liquors, and in the fame Manner to renew every fuch Licence from Year to Year, paying down the like Sum of twenty Shillings for each and every new Penalty id. or renewed Licence, at the Places and at the Times before mentioned ; and if any Perfon or Perfons for retaibg with- f na ]l prefume to offer or retale any of the faid Spirituous Liquors, without taking out fuch Licence, out a Licence; an( j renewing the fame yearly in Manner aforefaid, he, fhe or they fhall refpectively forfeit and lofe the Sum of ten Pounds for each Offence; and in cafe fuch Perfon or Perfons fhall refufe or neglect to pay the faid Sum of ten Pounds, the fame being lawfully demanded, it fhall and may be lawful for any one or more Juftice or Juftices of the Peace of any County, Riding, Divifion, City or Liberty, upon In- formation upon Oath being made before him or them of fuch Refufal or Neglect, by Warrant under his or to be kept to or their Hand and Seal, or Hands and Seals, to commit fuch Perfon or Perfons to the Hojife of Correction hard Labour two for the County, Riding, Divifion, City or Liberty wherein fuch Perfon or Perfons fhall refide, there to Months. remain and be kept to hard Labour for the Space of two Months, to be reckoned from the Day of the faid Commitment ; and the Perfon or Perfons fhall not be difcharged until he, fhe or they fhall have paid the faid Sum of ten Pounds, or until the full Expiration of the faid two Months. To whom l.i- X. And be it further enacted by the Authority aforefaid, That from and after the faid twenty-fifth cenccs (hall be £) a y f M arc h one thoufand feven hundred and forty-three, no Licence fhall be granted to any Perfon or grantc , Perfons whatfoever felling by retail any Spirituous Liquors or Strong Waters whatfoever, except to fuch Perfons only who fhall keep Taverns, Victualling-houfes, Inns, Coffee-houfes or Ale-houfes ; and if any fuch Licences fhall be granted to any other Perfons than as aforefaid, the fame are hereby declared void to all Intents and Purpofes. Provifti XI, Provided, and it is hereby declared, That nothing in this Act fhall extend, or be conftrued to enable any Perfon or Perfons to fell any Spirituous Liquors or Strong Waters by Retale, unlefs fuch Per- fon or Perfons be firft licenfed to fell Ale or Spirituous Liquors by two "or more of his Majefty's Juftices of the Peace for the County, Riding, Divifion, City or Liberty wherein fuch Perfon or Perfons fhall fell the faid Liquors, under the Hands and Seals of the faid Juftices. Provifo in Favour XII. Provided always, and be it enacied by the Authority aforefaid, That this Act, or any thing ot Phyficians, therein contained, fhall not extend to any Phyficians, Apothecaries, Surgeons or Chymifts, as to any pot -canes, Spirits or Spirituous Liquors, which they may ufe in the Preparation or making up of Medicines tor Chymifts' Sick, Lame, or diftempered Perfons only ; and that no Perfon or Perfons fhall be deemed or taken to be None to be a Retaler of Spirituous Liquors, who doth not by him, or herfelf, or themfelves, or by his, her or their deemed Re- Servant or other Perfon retale the fame, to be drank or confirmed in his, her or their Warehoufes, Store- taiers -who fliall houfes, Shops, Cellars, Vaults, Rooms, Sheds, or other Places to him, her or them belonging, or that a°pj" fhall otherwife retale or fend the fame abroad out of their faid Warehoufes, Storehoufes, Shops, Cellars, Vaults, Rooms, Sheds, or other Places, in lefs Quantities than one Pint.
