And be it further enacted by the Authority aforefaid, That from and after the twenty-fourth Day pable of being a f June one thoufand feven hundred and forty-five, no Perfon or Perfons, other than the Parties, Plain- tv PartiesTfor' tl ^ Defendant in the Caufe, fhall be incapacitated from being a Witnefs, touching any Offence corn- having played, mined againft the Laws for preventing exceffive and deceitful Gaming, by Reafon of having played, bet- ted or ftaked at any Game prohibited by this or any of the faid Statutes. VI. Provided alio, and it is hereby enacted and declared, That nothing in this Act contained fliall extend to prevent or hinder any Perfon or Perfons from playing at any Game whatfoever, within any of his Majefty's Royal Palaces, wherein his Majefty, his Heirs and Succeffors fhall then actually refide. VII. And be it further enacted by the Authority aforefaid, That no Privilege of Parliament fhall be No Privilege of allowed to any Perfon or Perfons whatfoever againft whom any Profecution or Proceedings fhall be com- pjiiiament to be menced or had, for keeping of any publick or common Gaming-houfe, or any Houfe, Room or Place for " playing at any Game or Games prohibited by this, or any other Act now in Being, againft exceffive or deceitful Gaming ; any Law, Ufage or Cuftom to the contrary in any wife notwithftanding. VIII. Provided neverthelefs, That if any Perfon fo offending fliall difcover any other Perfon fo offending, Offenders difco-- fo that fuch Perfon be thereupon convicted, the Perfon fo difcovering fhall be difcharged and indemnified -vering others from, all Penalties, by reafon of any fuch Offence, if fuch Perfon fo difcovering hath not been before con- s " victed thereof, and fliall be admitted as an Evidence to prove the fame. X. Provided always, and it is hereby declared, That nothing in this Act contained fhall extend, or be conftrued to extend, to repeal or invalidate an Act made in the ninth Year of the Reign of her late Ma- jefty Queen Anne, intituled, An Acl for the better preventing exceffive and deceitful Gaming. ' XI. And whereas in an Act palled in the thirteenth Year of his Majefty's Reign, intituled, An Acl ' to reflrain and prevent the exceffive Increafe of Horfe Races, and for amending an Acl made in the lajl ScJJion of 33 G:o. a, c. 191 ' Parliament., intituled, An Act for the more effectual preventing of exceffive and deceitful Gaming; it is §• 3. ' (among other Things) enacted, That from and after the twenty-fourth Day of June one thoufand ' feven hundred and forty, no Horfe, Mare or Gelding, being of the Age of five Years, fhall be entered, ' flatted or run, for any Plate, Prize, Sum of Money, or other Thing whatfoever, unlefs fuch Horfe, ' Mare or Gelding, fliall carry ten Stone Weight, computing fourteen Pounds to each Stone Weight j ' and that no Horfe, Mare or Gelding, being of the Age of fix Years, fhall be entered, flatted or run ' for any Plate, Prize, Sum of Money, or other Thing whatfoever, unlefs fuch Horfe, Mare or Geld- ' ing fliall carry eleven Stone, computing fourteen Pounds to each Stone Weight ; and that no Horfe, ' Mare or Gelding, being of the Age of feven Years, fhall be entered, flatted or run for any Plate, Prize, i Sum of Money, or other Thing whatfoever, unlefs fuch Plorfe, Mare or Gelding fhall carry twelve -' Stone Weight, computing fourteen Pounds to each Stone Weight; and in cafe any Perfon or Perfons

'* Prize, Sum of Money or other Thing, carrying lefs than the Weights herein before directed to be car- ' tied, fuch Horfe, Mare or Gelding, or the Value thereof, fliall be forfeited ; and the Perfon or Perfons 1 fo entering, ftarting or running fuch Horfe, Mare or Gelding, fliall forfeit and lofe the Sum of tw* ' hundred Founds : And whereas the thirteen Royal Plates of one hundred Guineas each, annually run c for, as alfo the high Prices that are conftantly given for Horfes of Strengh and Size, are fufficient to 4 encourage Breeders to raife their Cattle to the utmoft Size and Strength poffible ;' Be it therefore cnac— ed by the Authority aforefaid, That it fliall and may be lawful for any Perfon or Perfons, from and after ■^««iledi the twenty-fourth Day of June one thoufand feven hundred and forty-five, to run any Match, or to ftart and run fos any Plate, Prize, Sum of Money, or other Thing, of the real and intrinfick Value of fifty Pounds or upward*, at any Weights whatfoever, and at any Place or Places whatfoever, without incur- ring or being liable to the Penalty or Penalties in the faid Act of the thirteenth Year of his Majefty's Reign, relating to Weights as aforementioned, and in the fame Manner, as might have been done if the faid, Act had aeyer been made i any thing herein contained to the contrary notwithftanding.
