Damages recoverable. three or more of the Commiflioners of the Treafury for the Time being, and they are hereby authorized and required forthwith to caufe Exchequer Bills to be made forth at the faid Receipt, in fuch Manner as they or he fhall think moll fafe and convenient, for the faid Sum of one million, to be advanced or lent as afore- faid, or any Part thereof, to be charged upon and payable out of the faid feveral and refpedtive Rates,. Duties, and Affeffments, granted by the faid two Acts of Parliament herein before recited, together with an Intereft, after the Rate of four Pounds per Cintum per Annum, until Repayment of the faid principal Sum of one million, in fuch Courfe, Manner, and Form, as are mentioned in the faid Acts; and the faid Exchequer Bills to be made forth as aforefaid, fhall be fubjedt to all fuch Orders, Rules, Methods Direc- tions, Powers, Penalties, and Forfeitures, as are prefcribed, enadted, and declared in the faid two laft re- cited Adts, or either of them, in relation to Exchequer Bills thereby authorized to be made forth ; any thing herein contained to the contrary thereof notwithftanding. XVIIL And be it further enacted by the Authority aforefaid, That in cafe the faid Governor and Com- pany of the Bank of England, and their Succeflbrs, fhall- make Failure in any of the faid Payments, fo fo by this Act appointedto be made into his Majefty's Exchequer as aforefaid, at or before the refpedtive Days or Times to be limited in that Behalf, the Money whereof fuch Failure in Payment fhall be made, fhall and may be recovered to his Majefty's Ufe by Action of Debt, or upon the Cafe,. Bill, Suit, or In- formation, in any of his Majefty's Courts of Record at TFtjlminfter , wherein no Effbin, Protection, Pri- vilege, or Wager of Law fhall be allowed, or more than one Imparlance, in which Action, Bill, Suit, or Information, it fliall be lawful to declare, that the faid Governor and Company of the Bank of England are indebted to his Majefly the Monies of which they fhall have, made Default in Payment, according to the Form of the Statute, and have not paid the fame, which fhall be fufRcient ; and in or upon fuch Action, Bill Suit or Information, there fhall be further recovered to his Majefty's Ufe againft the faid Go- vernor and Company of the Bank of England,, and their Succeffors, Damages after the Rate often Pounds per Centum, for the Monies fo unpaid contrary to this Act,, befides full.
