' Act were prefcribed in that Behalf : ' Now it is hereby provided, enadted and declared by the Autho- rity aforefaid, That fo much of the faid Sum of twenty-fix thoufand feven hundred fever.ty-five Pounds fifteen Shillings and ten Pence, as is or fhall be more than fufficient to fatisfy the faid re- duced Officers, according to the Rules by the faid Adt prefcribed to be obferved in the Application thereof, or any Part of fuch Overplus, (hall or may be difpofed of to fuch Officers who are maim- ed or loft their Limbs in the late Wars, or fuch others as by reafon of their long Service or other- wife his Majefty fhall judge to be proper Objects of Charity ; or to the Widows or Children of fuch Officers, according to fuch Warrant or Warrants under his Majefty's Royal Sign Manual, as fhall be figned in that Behalf ; any thing in this Act, or the faid former Act to the contrary notwith- ftanding. ' XXX. And whereas feveral Bills, commonly called Exchequer Bills, feveral Tickets, commonly ' called Lottery Tickets, feveral Orders and Certificates made forth in lieu of the faid Lottery Tic- ' ets, and likewife for Annuities of divers Kinds, payable at or near the Receipt of his Majefty's

  • Exchequer, as alio feveral Receipts of the Cafhiers of the Governor and Company of the Bank

' of England, or fome of them, for Money contributed there for the Purchafe of Annuities, trans- ' ferrable in the Books of the faid Governor and Company, have, by Cafualty or Mifchance, been ' loft, burnt or otherwife deftroyed ; which Exchequer Bills, Lottery Tickets, Certificates, Receipts, ' Annuity Orders, and other Orders of the refpedtive Denominations aforefaid, were made forth by ' and in purfuance of feveral Acts of Parliament in that Behalf;' Be it therefore enacted by the Authority aforefaid, That in all Cafes where it fhall appear, by Affidavit to be made before any of the Barons of the Exchequer for the time being (who fhall interrogate the Deponent thereupon) to the Satisfaction of fuch Baron or Barons, that any fuch Exchequer Bills, or any fuch Tickets, Certificates, Receipts, Annuity Orders, or other Orders as aforefaid, before the flrft Day of Jugujl one thoufand feven hundred and forty-fix, have been, or are, loft, burnt or otherwife deftroved, or that there be good Reafon to believe the fame have been burnt, loft or otherwife deftroyed ; it lhall and may be lawful for the refpedtive Officers and Perfons appointed to iffue or make forth fuch Exchequer Bills, Tickets, Certificates, Receipts, Annuity Orders or other Orders, or to pay or dif- charge the fame, or to iftue any Monies due or payable thereon, upon producing a Certificate from any of the faid Barons, of fuch Affidavit made before him (which Affidavit the faid Barons, or any of them, is and are hereby authorized to take ; and which Certificate he or they are hereby requi- red to make and grant, without Fee or Reward) and, on Security given to the faid refpedtive Officers .and Perfons, to their good Liking, to indemnify them refpectively againft all other Perfons whatfo- eyer, for or concerning the Monies fpecified in, or due upon, fuch refpedtive Bill or Bills, Ticket or Tickets, Certificate or Certificates, Receipt or Receipts, Order or Orders, they the faid Perfons and Officers refpectively, fhall, and are hereby required to make forth Duplicates of the faid Bills, Tickets, Certificates, Receipts and Orders, at the Requeft of the refpeclive Owners, and to pay and difcharge the fame, and all fuch Intereft as is or lhall be due on any of them carrying Intereft, or to make forth Stock or transferable Annuities, in lieu of fuch Receipts as he or they fhould have paid or difcharged, or made forth on the faid original Bills, Tickets, Certificates, Receipts, Annuity Orders, or other Orders, if the fame had been produced, and fhall be allowed all fuch Payments, Sum or Sums of Money in their refpedtive Accounts ; and in all Cafes where the Signing of the Com- miffioners of his Majefty's Treafury, or the Lord High Treafurer of G.reat Britain for the time being, is necefTary for making the laid Duplicates, or any of them effectual, for the Purpofes afore- faid ; it is hereby further enadted, That it fhall and may be lawful to and for the faid Commiffioners of his Majefty's Treafury, or any three or more of them, or the Lord High Treafurer for the time being, to iign fuch Duplicates accordingly. . ■ . An Aft for amending the Laws relating to Bankrupts. ' TT T HE RE AS many Perfons within the Defcription of, and liable to the Statutes concerning Bank- ' . W rupts, frequently commit fecret Acts of Bankruptcy unknown to their Creditors and ether 'Perfons, with whom, in the Courfe of Trade, they have. Dealings and Tranfadtions ; and after the ' committing thereof, continue to appear publickly and carry on their Trade and Dealings, by buying ' and felling of Goods and Merchandizes, drawing, accepting and negociating Bills of Exchange, and

  • paying and receiving Money on Account thereof, in the ufual Way of Trade, and in the fame open

' and publick Manner as if they were folvent Perfons, and had not become Bankrupts : And whereas ' the permitting fuch fecret Ad! s of Bankruptcy to avoid and defeat Payments, really and bona fide

  • made in the Cafes, and under the Circumitances above-mentioned, where the Perfons receiving the

' fame had not Notice of, or were privy to fuch Perfons having committed any Adt of Bankruptcy, wilt ' be a great Difcouragement to Trade and Commere, and a Prejudice to Credit in general:' Be k therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament alTembled, and by the Au- thority of the fame, That from and after the twenty-ninth Day of Oftobcr in the Year of our Lord 8 one
