Provided always, and be it enacted. Commiffioners XXVIil. Provided always, and be it enaded, That if any Perfon hereby appointed a Commif- InK^brforsth'^y fio"sr for ally County, City, Town or Place in England, JVales or Benvick upon Tweed (except as fcave taken ihe before excepted) fliall prefum.e to ad as a Commiflioner in the Execution of this Ad, before he Oaths, {hall have taken the faid Oaths, which by this Ad he is required to take, and in the Manner hereby forfeit 200 1. prefcribed, he fliall forfeit to his Majefty the Sum of two hundred Pounds, to be recovered by Adion of Debt or on the Cafe, Bill, Suit or Information, in any of his Majefl:y's Courts of Record at IFejhninJler, wherein no Effoin, Protedion, Wa^er of Law, or more tlian one Imparlance fliall be allowed; and that if any Perfon hereby appointed a Commiffioner for any Shire, Stewartry, Burgh and Commiflio- or Place m Scotland (except as before excepted) ihall prefume to ad as a Commiffioner in' the Exe- ners in Scotland cution of tliis Ad, before that he fliall have qualified himfelf according to the Laws in Scotland,- he ^° ■ fliall foifeit to his JVIajefty the Sum of fifty Pounds, to be recovered in the Court of Exchequer in Scotland, in the fame Manner as any other Penalties are there recoverable. Coinmimoners XXIX. Provided alfo, That in cafe there fliall not be a fufficient Number of Commiffioners for for the County ^^y City, Borough, Town, Port or Place of Great Britain (for which by this Ad Commiffioners foiaify cityj&c. ^te fpecially appointed) capable of ading according to the reipedive Qiialifications required by this Ad, then and in every fuch Cafe, any the CommilFioners appointed for the County, Shire or Stew- artry at large, within which fuch City, Borough, Town or Place doth ftand, or which is next ad- joining thereto, may ad as Commiffioners in the Execution of this Ad, within fuch City, Borough, Town, Port or Place; any Thing herein contained to the contrary notwithflanding. Qnaiification of XXX. Provided always, and be it enaded by the Authority aforelaid. That no fuch Perfon fliall Cornniiirioncrs j^g capable of ading as a Commiffioner in the Execution of this Ad, or of any of the Powers there- la iRe'^vvUMri'" '^^ contained, in or for any County at large, within England, the Dominion of JFales (the Counties Engl*nd. of Auglefey, Merioneth, Cardigan, Cartnarthen, Glamorgan, Montgomery, Pembroke, Carnarvon and Mon- mouth excepted) or in or i'or any of the Ridings in the County of y'ork, unlefs fuch Perfon, Vy him- felf or his Tenants or T'ruftees, was taxed, or did pay in the fame County or Riding, tor the Value of one hundred Pounds per A'nniim cr more of his own Eftate, by virtue of the laid Ad for the Land Tax made and pafled in England, in the twenty-eighth Year of his Majefty's Reign, or any fubfe- quent Ad or Ads of Parliament for that Purpofe, or unlefs fuch Perfon fo appointed to be a Com- miffioner, fliall, at the Time of the Execution of this Ad, by himfelf, his Tenants or Truftces, en- joy an Eii:ate of Lands, Tenements or Hereditaments, of the faid yearly Value of one hundred Pounds or more, within the faid County or Riding refpedively j any Thing herein contained to the contrary notwithflanding. Perfons difubicd XXXI, And it is hereby further enaded.
