C. 1* . 67 the proper Officer be produced, that it hath paid the faid Duty of three Pence per Bufhel in Scotland; and if fuch Certificate be produced, then there {hall be paid no more than three Pence />«- Bufhel, by virtue of this Adt, for fuch Malt fo brought into England ; and in cafe the fame fhall be brought by Land, fuch Malt Brought by La*.?, fhall pafs and be carried by and through the Towns of Berwick or Carlijle, and there entered with the Of- r ° t* entered at ficer for the faid Duties in fuch of the faid Towns, by or through which fuch Malt fhall be fo carried ; and >;fle WK ° r "" the like Duty of fix Pence per Bufhel for the fame fhall be paid down in ready Money, unlefs fuch Certi- ficate be produced as aforefaid ; but upon producing thereof, then there fhall be paid no more than three Pence per Bufhel, by virtue of this Act, on pain of forfeiting all fuch Malt, or the Value thereof, as fhall be landed or put on fhore, or brought into England without fuch Entry or Payment of Duties as aforefaid : And in cafe any Malt made in Scotland fhall, during the faid Term, be found coming out of Scotland, or be brought from thence by Land, by or beyond the Towns before-mentioned, without Entry or Payment of the Duties thereof, then all fuch Malt, or the Value thereof, fhall be forfeited, and may be feifed by any Officer of Excife, for his Majefty's Ufe ; one Moiety of the aforefaid Forfeiture to be and go to the King's Majefty, and the other Moiety thereof to fuch Perfon or Perfons as fhall inform, feize or fue for the fame, or the Value thereof; and to be recovered and levied by fuch Ways, Means and Methods as any Penalties and Forfeitures are by this or any the former Adts, relating to the Malt Duties, to be recovered and levied ; or by Action of Debt, or upon the Cafe, Bill, Plaint or Information in any of his Majefty's Courts of Re- cord at Weftminjler, wherein no Effoin, Protection, Privilege, Wager of Law, or more than one Imparlance Ihall be allowed. . VII. Provi lings per) of Strong 1 any former Adt, to the contrary notwithstanding. VIII. And be it further enadted by the Authority aforefaid, That from and after the twenty-fourth Day Diftiller to give of 'June one thoufand feven hundred and fixty-four, all and every Diftiller or Diftillers that fhall receive Notice to Officer any Quantity of Cyder or Perry into his, her or their Cuftody, fhall give Notice in Writing to the proper ™ b J n he diftlls Officer, under whofe Survey any fuch Diftiller fhall refide, forty-eight Hours before he, fhe or they fhail ' cr ' begin to put any Quantity whatfoever of the fame into any Still or Stills to be drawn into Low Wines or Spirits; and if any fuch Diftiller or Diftillers fhall negledt or omit to give fuch Notice, or if it fhail ap- pear that any Quantity whatfoever of fuch Cyder or Perry hath been difpofed of, or made ufe of, by any fuch Diftiller or Diftillers, in any other Way, but in Diftillation only, he, fhe or they fhall refpedtively forfeit and lofe the Sum of five Pounds ; which faid Sum of five Pounds fhall be fued for, levied, reco- vered and mitigated by fuch Ways and Means, as any Penalty or Fine for any Offence committed by any Perfon or Perfons againft any of the Laws of Excife can or maybe fued for, levied, recovered and miti- gated, or by Adtion of Debt, Bill, Plaint or Information in any of his Majefty's Courts of Record at Weft- minjler ; and that one Moiety thereof fhall be to his Majefty, his Heirs and Succeflbrs, and the other Moiety thereof to fuch Perfon or Perfons as will profecute, inform or fue for the fame. IX. And be it further enacted by the Authority aforefaid, That from and after the faid twenty-fourth Allowances for Day of 'June one thoufand feven hundred and fixty-four, there fhall be allowed to Malfters and Makers of Exportation of Malt for Exportation, for every twenty Quarters of Barley, or other Corn or Grain that fhall be entered Malt * and made into Malt for Exportation, in Cafes where by Law any Bounty is allowed on the Exportation of Malt, an Allowance of thirty Quarters, after the fame fhall be dried and made into Malt, and no more, upon the Exportation thereof, though by their fteeping, wetting or watering the fame, the faid twenty Quarters fhall be run out to any greater Quantity exceeding the (aid thirty Quarters, according to an Adt of Parliament made in the firft Year of the Reign of their late Majefties King William and Queen Mary, iW.&M, t.is. intituled, An Acl for encouraging the Exportation of Corn; and in fuch Cafes where, by the aforefaid Act of Parliament, they are intitled to the fame ; and fo in proportion for a greater or lets Quantity. X. And be it further enacted by the Authority aforefaid, That from and after the faid twenty-fourth On Certificate of Day of June one thoufand feven hundred and fixty-four, if any Perfon or Perfons who fhall export any Malt being ex- Malt into foreign Parts, fTiall produce a Certificate or Certificates from the Officer or Officers, with whom P orteo > and Secu - the Entry of the Corn or Grain intended to have been made into Malt fhall have been made, of the parti- to bepaidr*"** cular Sum or Sums of Money that fuch Perfon or Perfons is or are intitled to receive, according to the aforefaid Allowance of thirty Quarters of Malt for every twenty Quarters of Corn or Grain, and fo in pro- portion for a greater or Iefs Quantity, that fhall have been entered to be made into Malt for Exportation (which Certificates the faid Officers are hereby upon Demand required to give gratis) ; and upon fuch Per- fon or Perfons giving fufficient Security before the fhipping thereof for Exportation, that the particular Quantity of Malt which fhall be intended to be exported as aforefaid, or any Part thereof, fhall not be re- landed, or brought again into any Part or Parts of Great Britain (which Security the Cuftomer or Collector of the Port where the fame is intended to be exported, is hereby diredted and authorized to take in his Ma- jefty's Name, and to his Majefty's Ufe) then the Collector or Chief Officer of the Port where fuch Malt ihall he exported, fhall give to the Exporter thereof a Certificate or Debenture diredted to the proper Per- fon or Perfons by whom the faid Allowance by the aforefaid Adt of Parliament is directed to be paid; which Certificate or Debenture being produced to fuch Perfon or Perfons, he is hereby required to pay fuch Allowance to the Perfons, or their Agents, fo exporting the fame. XL Provided always, That if after the fhipping of any fuch Malt to be exported, and the giving fuch Penalty on re. Security as aforefaid, in order to obtain the aforefaid Allowance, the Malt fo fhipped to be exported, or landing, any Part thereof, fhall be relanded in any Part of Great Britain ; that then, and in every fuch Cafe, over and above the Penalty of the Bond, which ihall be levied and recovered to his Majefty's Ufe, all the Malt K 2. which
