C. 1; 77 .to be paid, out of the Monies which fhall, from Time to Time, be iffued to the faid Paymafter or Pay- mafters as aforefaid ; any former Law or Statute to the contrary notwithstanding. LVII. And it is hereby enacted by the Au hority aforefaid. That no Fee, Reward or Gratuity, fhall Be*? Fde t0 he demanded or taken, directly or indirectly, by any of his Majesty's Officers in theExchequer,_or by any df "'""■ their Clerks or Substitutes, or by any fuch Paymafter or Comptroller,, oriby their .or either of theirClerks or SubStitut.es, from any of his Majefty's Subjects, .for any Matter or Thing to bedone by the faid Officers jn the Exchequer, or by the faid Paymafter or Comptroller, or .any of them, their or any of their Clerks or Subftitutes refpectively, in purfuance of this Act; and that no fuch Officer in the Exchequer, Pay- mafter or Comptroller, or any fuch Clerk or Substitute, .fhall divert or mifapply, or caufe or procure to be diverted or mifapplied, any of the Monies by this Ad intended for the exchanging, circulating and paying off the faid Bills, or any of them, under fuch Penalties and Forfeitures to -be incurred by and inflicted on them refpectively, as by this Act are prefcribed and enacted for diverting and mifapplying any the Monies of the (aid Rates and Duties hereby granted, or for taking -or demanding any Fee, Reward or Gratuity con- cerning the fame. I.-V1II. Provided always, and it is hereby enacted, That as often as any Intereft upon anyExchequerBill k° Intereft for or Bills to be made forth by this Act, fhall be demanded to be ,paid,.the faid Contractors or Paymafters fhall p^ n than one not be obliged to pay for fuch Intereft, to any leffer Sum than one Penny upon fuch Bill, in cafe a fingle Bill be produced, or for the Total of the Intereft of fuch Bills, where two pr more fhall be offered at one Time by the fame Perfon ; any Thing herein contained to the contrary notwithstanding. LIX. Provided alfo, and it is hereby enacted by the Authority aforefaid, That the laid Commiffioners Charges to be of the Treafury, or any three or more of them now being, or the High Treafurer, or any three or more of P?"! -""p ff the Commiffioners of the Treafury for the Time being, fhall have Power, and he or they are hereby enabled ° to pay and allow, or caufe to be paid and allowed, out of the Monies to arife of or for the faid Rates and ■Duties hereby granted, or of or for the faid Surpluffes, Exceffes or. Overplus Monies, 'and other .Revenues compofing the Sinking Fund, from Time to Time, the neceffary Charges of making forth the new Ex- chequer Bills hereby authorized to be made forth, and fuch other Charges as fhall be neccffarily incident in or for the Execution of this Act, or any Part thereof, in relation to the faid Bills ; any Thing herein con- tained to the contrary notwithstanding. LX. Provided always, and be it enacted by the Authority' aforefaid, That whatever Monies fhall To be replaced bciflued out of the faid Surpluffes, Exceffes or Overplus Monies, and other Revenues compofing the Sink- ° ut °. the firffi in«- Fund, fhall, from Time to Time, be replaced -by and out of the firft Supplies to be then after granted " pp ies ' in Parliament ; any Thing herein contained to the contrary notwithstanding. LXI. Provided alfo, and it is hereby enacted, That in cafe Proof fhall be made on Oath of one or more claufe of Re l ;ef credible Witnefs or Witneffes, before the Lord Lhief Baron and other the Barons of the Coif of his Ma- £ r ftr B '" s d loft " jefty's Court of Exchequer, or any of them, that any of the Bills, which fhall have been made forth by virtue of this Act, were by Cafualty or Mifchance loft, burnt, or otherwife deftroyed, before the coming thereof in courfe of Payment; and if by the Party's Oath the Numbers and Sums of fuch Bill or Bills fhall be afcertained.; and if thereupon the faid Chief Baron, and other the faid Barons, or any of them, before whom fuch Oaths were made, fhall certify that he or, they are fatisfied in fuch Proof; then, and in every fuch Cafe, the Commiffioners of the Treafury. or any three or more of them now being, or theHigh. Treafurer, or any three or more of the Commiffioners of the Treafury for the Time being, are hereby au- thorized to caufe the Money due upon fuch Bill or Bills, fo loft, burnt or deftroyed, to be fatisfied by the faid Paymafter or Paymafters, as if the original Bill or Bills were brought in to be paid off; Drovided that the Perfon or Perfons fo receiving the Money do give Security to the King, to the good Liking of the Perfon or Perfons who fhall be appointed, as aforefaid, to pay off" and take in the faid Bills, to pay into the Exchequer, for the Ufe of the Publick, fo much Money as 'fhall be paid upon fuch Certificate or Cer- tificates, if the Bill or Bills fo certified to be loft, burnt or deftroyed, be hereafter produced. LXII. Provided alfo, and it i- hereby enacted by the Authority aforefaid, That all and every the Bills to Bills difcharged be made forth by virtue of. this Act, which fhall, from Time to Time, be difcharged and paid off", fhall be £o be cancelled, taken in and filed, and fhall be cancelled and made void, according to fuch Rules and Directions as the faid Commiffioners of the Treafury, or any three or more of them now being, or the High Treafurer, or any three or more of the Commiffioners of the Treafury for the Time being, fhall by any Warrant or W ar- rants under their Hands direct or appoint. LXIII. Provided always, and it is hereby likewife enacted by the Authority aforefaid, That all the Mo- Sinking Fund nies arifen or to arife into the Exchequer of or for the faid Surpluffes, Exceffes or Overplus Monies, and !° f 'T opnat ^ t0 other Revenues, compofing the Sinking Fund (except fuch Monies thereof, as are by this or any other tjonal Debts in- Act or Acts of this or any former Seffion or Seffions of Parliament, efpecially charged upon the faid Sink- cuned befcie 25 ing Fund, or to be paid out of the fame, or out of any Revenues or Branches compofing the faid Sinking Dec. 1716. Fund) fhall be appropriated, referved and employed to and for the difcharging the Principal and Intereft of fuch National Debts and Incumbrances, as were incurred before the twenty-fifth Day of December one thoufand feven hundred and fixteen, and are declared to be fuch National Debts, as may be redeemed, and are provided for by Act of Parliament, in fuch Manner and Form as fhall be directed and appointed by any future Act or Acts of Fatliament to be difcharged therewith, or out of the fame, and to none other 'Ufe, Intent or Purpofe whatfoever; any Thing in this Act contained to the contrary notwithstanding. ' LXIV. And whereas feveral Orders of Loan or Exchequer Bills, made upon and in purfuance of an ' Act of Parliament of the fecond Year of his prefent Majefty's Reign, for continuing the Duties upon
- Malt, Mum, Cyder and Perry, ftill remain undifcharged for want of fufficient Money arifing by the faid
' Duties being come into the Exchequer, tofatisfy and difcharge the fame, and it is uncertain how much ' thereof
